The Director of Health may inspect all dairy farms and milk
plants whose milk or milk products are intended for sale or consumption
within the Town.
The Director of Health may take samples of milk from dairy farms,
milk plants, delivery trucks, stores, cafes, soda fountains, restaurants
and other places where milk or milk products are sold as often as
deemed necessary and have these examined at an approved laboratory.
Samples may be taken at any time prior to the delivery of the milk
products to the final consumer.
All proprietors of stores, cafes, restaurants, soda fountains,
hotels, boardinghouses and other similar places shall furnish the
Health Department inspector, upon his request, with the names of all
distributors from whom their milk and milk products are obtained.
Whenever the average bacterial count obtained from three successive
samples of milk taken at least three days apart and within 30 days,
as determined by analyses made in a laboratory approved by the State
Department of Health, falls beyond the limit for the grade then held,
the health officer shall notify the person concerned, and such milk
shall not be offered for sale until regraded.
The sale of bulk milk except to manufacturing plants for use
in their manufactured products is prohibited.
All milk for home or individual consumption shall be placed
in approved bottles or cartons.
Any person who shall violate any of the provisions of this chapter
shall be fined not more than $100, imprisoned not more than 30 days,
or both, for every such violation.
