The Board of Health of the Town of Yarmouth
hereby advises all owners of poultry and/or swine being housed within
the Town of Yarmouth that a poultry and/or swine license is required.
To obtain a license, all owners must first file an application with
the Health Department. No person shall be granted a license unless
compliance is met with the requirements of the regulations governing
poultry and swine.
The Board of Health may grant variances from
the poultry and/or swine regulations, provided that the variance is
requested prior to March 21, 1980, and that the following guidelines
can be met: if said poultry and/or swine have been housed on the property
in question for a period of not less than one year with the implicit
acceptance of any abutting neighbors of said property and the construction
and upkeep of the housing and property thereon are maintained in a
sanitary condition without endangering the public health in any way,
said poultry and/or swine housing, meeting all of the above requirements,
may then continue on the following basis:
A. To be continued only for the same number of poultry
as is existing and/or determined by the Board of Health.
B. To be continued only for the present owners of the
property in question.
C. To be continued only if no valid complaints substantiated
by the Board of Health as a public health hazard and/or nuisance are
registered.
If said premises are found to be in violation of any of the above criteria, the Board of Health will take immediate action to have the poultry and/or swine removed from the property under §
196-18, Contents and service of orders, and §
196-38, Contents and service of orders, of this chapter.
