For the purposes of this chapter, the term "Borough" specifically includes the Recreation Commission. The following terms shall have the meanings indicated:
RECREATION AREAS
Any property owned or leased to the Borough of Franklin that is used for open space and recreation purposes and that is open to the public either without charge or on a fee basis. The term includes, but is not limited to, playgrounds, parks, ball fields and any paths, roadways, sidewalks and parking areas therein and adjacent thereto.
RECREATION COMMISSION
The appointed members and employees of the Borough of Franklin Board of Recreation Commissioners.[1]

Recreation areas within the Borough of Franklin shall be open for use between the hours of sunrise and sunset only. However, in the event a program or event is sponsored or approved by the Borough, including events for which a Borough permit has been issued, the hours of operation shall be as determined by the Borough.
A. 
Any section of a recreation area may be closed, either partially or entirely, by the Mayor and Council, Recreation Commission, Public Works Committee Director or the Chief of Police, for any interval of time, when it is necessary or prudent.

B. 
In the event a permit holder fails to comply with an authorized closure notice, the permit shall be automatically deemed void for the remainder of the term of the permit.
Use of recreation areas shall be subject to the rules and regulations approved by the Recreation Commission as ratified by the Mayor and Council. (Exhibit A).[1]

No person shall do any of the following on any Borough-owned property, including but not limited to recreation areas:
A. 
Construct or erect any building or structure of any kind, whether permanent or temporary, or construct or locate any public utility upon or across any municipal property except upon the written approval of the Recreation Commission and Mayor and Council.
B. 
No improvements, maintenance or structural changes shall be made to any recreation area by an organization/persons at any time without prior written approval by the Recreation Commission and Borough Council (excluding pregame set-ups and lining of the fields.)
C. 
All requests for improvements, maintenance or structural changes must be made in writing and submitted to the Recreation Commission no later than two months before they are to be performed. Depending upon the extent of the work requested, such requests shall also be subject to approval by the Recreation Commission, Borough Council and Planning Board, Construction permits and inspections will be required.
D. 
The Recreation Commission or the Mayor and Council may invalidate and rescind permits if field repairs or adjustments are attempted without prior written consent of the Recreation Commission, with the exception of emergency repairs by the Department of Public Works.
A. 
Enforcement of this chapter, as well as the rules and regulations, shall be by the Police Department.
B. 
Any person, firm or corporation violating any of the provisions of this chapter, as well as the rules and regulations, upon conviction, shall be subject to the general penalty provisions as provided for in Franklin Borough Code § 1-15.
