As used in this chapter, the following terms shall have the meanings indicated:
MIGRATORY WATERFOWL
Includes those nondomesticated species of birds commonly known as "swans," "geese," "brant," "river and sea ducks" and any other waterfowl otherwise defined under New Jersey or federal law as migratory waterfowl.
It shall be unlawful for any person to feed any migratory waterfowl on any publicly or privately owned property in the Township of Medford, after notice has been posted as provided herein.
A. 
When so directed by the Medford Township Police Department, and at the property owner's expense, signs not less than 18 inches by 24 inches in size, bearing the words "Feeding of Waterfowl Prohibited," together with any qualifications, shall be conspicuously posted by the owner of the property. This section shall not pertain to residential properties.
B. 
Defacing, tampering with or damaging such signs when posted shall constitute a violation of this section.
A. 
This section shall be enforced by the Medford Township Police Department.
B. 
Whenever the Police Department becomes aware that migratory waterfowl are being fed in violation of this section, they may issue a summons which shall be answerable before the Municipal Magistrate.
A. 
Any person violating this chapter shall be subject to a warning for the first violation. It is not the intent of Council to penalize people for feeding waterfowl but rather to educate and thereby discourage people from so doing.
B. 
A person violating this chapter for a second time shall be subject to fine of not less than $25 nor more than $100.
C. 
A person violating this chapter for a third or subsequent time shall be subject to a fine within the discretion of the Municipal Court Judge, but in no event shall it exceed the maximum allowable under N.J.S.A. 40:49-5, as amended and supplemented, and other applicable law.
