Pursuant to the provisions of § 1640
of the Vehicle and Traffic Law of the State of New York, the Department
of Public Works and the Police Department of the Incorporated Village
of Garden City are hereby authorized to remove and store any vehicle:
A. Being operated either without proper financial security
or registration as required by Articles 3 and 4 of the Vehicle and
Traffic Law or by a person not properly licensed as required by Article
5 of the Vehicle and Traffic Law.
B. Which is parked or abandoned on a public highway within
the village during any snowstorm, flood, fire or other public emergency.
C. Which is found unattended where such vehicle constitutes
an obstruction to traffic or where stopping, standing or parking is
prohibited.

Any such vehicle so removed shall be impounded
and stored in a place designated by the Department of Public Works
or the Police Department and shall be held until the owner or operator
thereof shall call for and remove the same. Before any vehicle so
impounded is released, the owner or operator thereof shall pay to
the Department of Public Works or the Police Department or their designated
agent a fee in such amount as determined from time to time by resolution
of the Board of Trustees for the cost of impounding and storing such
vehicle, plus any expense incurred by the Department of Public Works
or the Police Department or their designated agent for towing and
removing such vehicle from the public highway whereon it was parked
or abandoned to such place of storage, together with an administrative
fee for the cost of impounding and releasing such vehicle. Such charges
shall be a lien on any vehicle so impounded and shall be paid in cash
or certified funds before the same shall be released from the custody
of the Department of Public Works or the Police Department or their
designated agent.
