Editor's Note: This local law also repealed
former Ch. 57, Fire Prevention, adopted 1-29-1979, as amended.
There is hereby adopted by the Town of Hyde Park for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion that certain code known as the "New York State Uniform Fire Prevention and Building Code" and found in Title 9, Subtitle S, Chapter 1 found in Volume 9 Executive (B) of the Official Compilation of Codes, Rules and Regulations of the State of New York. Such code will be on file in the office of the Clerk of the Town of Hyde Park, and the same is hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this chapter shall take effect, the provisions thereof shall be controlling within the limits of the Town of Hyde Park.
A.
The Uniform Fire Prevention and Building Code shall
be enforced by the Fire Inspector of the Town of Hyde Park, who shall
operate under the supervision of the Town Board.
B.
A report of the Fire Inspector shall be made monthly
and transmitted to the Supervisor of the Town. It shall contain all
proceedings under this code, with such statistics as the Fire Inspector
decides to include therein. The Fire Inspector shall also recommend
any amendments to the code which, in his judgment, shall be desirable.
C.
The Fire Inspector may request and shall receive so
far as may be necessary in the discharge of his duties the assistance
and cooperation of other officials of the Town.
D.
The Fire Inspector is hereby empowered to issue appearance
tickets for violations of this code.
E.
The Fire Inspector is hereby empowered to collect
fees set by resolution of the Town Board for the regular, periodic
inspections of public buildings, nonresidential occupancies and multiple
dwellings. A report shall be submitted each month showing fees charged
and collected.

A.
Any person who shall violate any of the provisions
of the code hereby adopted or fail to comply therewith or who shall
violate or fail to comply with any order made thereunder or who shall
build in violation of any detailed statement of specifications or
plans submitted and approved thereunder or any certificate or permit
issued thereunder or who shall fail to comply with such an order as
affirmed or modified by the Fire Inspector shall, severally, for each
and every such violation and noncompliance, respectively, be subject
to a fine of not more than $250 or imprisonment of not more than 15
days, or both. The imposition of one penalty for any violation shall
not excuse the violation or permit it to continue, and all such persons
shall be required to correct or remedy such violations or defects
within a reasonable time, and, when not otherwise specified, each
one day that prohibited conditions are maintained shall constitute
a separate offense.
B.
The application of the above penalty shall not be
held to prevent the enforced removal of prohibited conditions.
