[HISTORY: Adopted by the Board of Trustees of the Village of Piermont 11-14-1977 by L.L. No. 27-1977 as Ch. 110 of the 1977 Code. Amendments noted where applicable.]
The Board of Trustees of the Village of Piermont, being fully cognizant that, because of the limited confines of areas within the Village of Piermont and the close proximity thereto of residents and other structures and property inhabited and used by residents of the Village, the use of weapons and firearms in the Village is a matter affecting the public health, safety and welfare which should be subject to control by the Village of Piermont.
No person shall, except in self-defense and when reasonably necessary for the protection of life or property, fire or discharge, or cause to be fired or discharged, any pistol, rifle, shotgun, air- or gas-operated guns, longbow or any other type of firearm within 500 feet of any building or playground, including the use or possession of firecrackers, rockets, gunpowder and fireworks of every kind and description.
A. 
The provisions of this chapter shall not apply to:
(1) 
Any peace officer while engaged in carrying out his duties.
(2) 
The regulated use of a pistol, rifle or target range operated under a Village permit and maintained by any duly organized membership corporation.
(3) 
Programs conducted by public schools offering instruction and training in the use of firearms or longbows.
(4) 
Programs offering instruction and training in the use of firearms conducted by the Village Recreation Department or by persons certified by the National Rifle Association or approved by the New York State Conservation Department.
B. 
Notwithstanding the foregoing, no person shall discharge a firearm in such a way as will result in the load passing over a public highway or any part thereof or discharge a firearm within 500 feet of any building or playground.
The police officers of the Village are hereby authorized to seize and retain any pistol, rifle, shotgun, air- or gas-operated gun, longbow or any other type of firearm, including firecrackers, rockets, gunpowder and fireworks of every kind and description, which shall be used, discharged or possessed within the Village in violation of this chapter until disposition of the case.
