No person shall carry on a business of buying, selling or dealing in junk, rags, metals, paper and other old materials, except antique furniture, books, bottles, etc., without first obtaining a license therefor.
Application for a license shall be made to the Village Clerk-Treasurer, giving the applicant's full name and address, the location of the proposed place of business and such other information as the Clerk-Treasurer may require.
Upon approval of the application and receipt of the required annual fee, as established by the Village Board of Trustees,[1] the Clerk-Treasurer shall grant the license, subject to conformity with Chapter 250, Zoning, and all other applicable laws and ordinances.

Any vehicle used in the pursuit of business shall be plainly marked with the name and address of the license and his junk license number.
Each license shall observe the following regulations:
A. 
Loans. No licensee shall receive any article or thing by way of a pledge or pawn, nor shall a license loan or advance any sum of money on the security of any such article.
B. 
Juveniles. No licensee shall purchase or receive any goods or articles whatever from any person under the age of 18 years.
C. 
Hours limited. No licensee shall purchase, solicit or collect any article or thing between the hours of sunset and 8:00 a.m. in the morning.
D. 
Scavenging. No person shall collect, retrieve, scavenge or handle any article or material which has been discarded by the owner thereof and placed by the roadside for collection by the Village collectors.
When requested by the Police Chief, any licensee shall keep a written record and report to said Chief all articles received, purchased or sold during the period of time specified in such request, together with the name and address of each seller and/or buyer thereof.

Any person, firm or corporation violating any provision of this article shall, upon conviction thereof, be punishable by a fine of not more than $250 or imprisonment for a term not exceeding 15 days, or both.

It is hereby declared that abandoned, junked, discarded, dismantled and unregistered motor vehicles in and upon privately owned real property within the Village of Scotia are a matter affecting the public interest. They constitute a nuisance in that health, fire and safety hazards are created. They constitute an attractive nuisance to children and are a peril to their safety. This matter is a source of vexation and annoyance and depreciates the value of neighboring properties. The preservation of public health and protection of property and the elimination of public hazards compel the Board of Trustees of the Village of Scotia to legislate on this matter. It is hereby declared that adoption of this article has for its purpose the effective termination of such practices.
As used in this article, the following terms shall have the meanings indicated:
JUNKED VEHICLE
Any vehicle, including a trailer or motorcycle, which fails to display a currently valid and properly attached New York State inspection sticker or which fails to display a currently valid registration sticker or which has no license plates. This shall apply to such vehicles which are offered for sale.

It shall be unlawful for any person, firm or corporation, either as owner, occupant, lessee, agent, tenant, vehicle owner or otherwise, to store or deposit or cause or permit to be stored or deposited a junked vehicle in and upon any vacant lot or land or vacant place or upon the surface of any lot or land, fenced or otherwise, within the Village of Scotia. Nothing in this article shall prohibit the parking of a junked vehicle in a private garage that is completely enclosed.

This article shall not apply to properties used in conjunction with a legally established motor vehicle service station, repair shop or dealership in use.

The Building Inspector, in enforcing the provisions of this article, shall have the power to enter, examine and inspect any land, lot, yard, court or building to determine whether any violations exist.

The Village Police Department shall assist the Building Inspector in determining property or vehicle owner information and license plate and registration validity.
