A. 
It shall be unlawful for any person to place or allow to be placed any prohibited article or material, designated recycling material, covered devices, tire or wheel in his waste or at curbside for garbage collection.
B. 
It shall be unlawful for any person to dispose of any waste or recycling material in the municipality except in accordance with the provisions of this chapter.
C. 
It shall be presumed that any designated recycling material, covered device, wheel or tire found commingled with waste on the property of a person is the property of such person if identifiable indicia of ownership is contained therein.
The resident, owner, person or occupant in charge of the property from where the trash or private recyclable materials has been picked up shall remove or cause the emptied containers to be removed from the curbline or front yard and shall cause the emptied containers to be placed or stored either inside a garage or behind the front facade line of the dwelling no later than 12:00 midnight on the day of pickup.
Any resident, occupant or person in charge of any property in the Township who neglects, fails or refuses to comply with this article shall, upon conviction thereof by any Magisterial District Judge or other court of competent jurisdiction in Allegheny County, Pennsylvania, be sentenced to pay not more than $600 for each offense, plus costs. Each day the offense continues shall constitute a separate offense and shall be punishable as the same.
