Under the authority of MGL c. 43, § 5, there is hereby established an Office of Cultural Affairs under the jurisdiction of the Mayor.
It shall be the function of the Office of Cultural Affairs to promote the cultural activities of the City of Marlborough; to seek federal, state and local funds; to accept grants, gifts and any other gratuities with the approval of the Mayor and City Council, and to coordinate cultural activities as may be assigned to it.

A. 
The Office of Cultural Affairs shall consist of 15 members, who shall be appointed by the Mayor, subject to confirmation by the City Council, and who shall serve without compensation, each for a term of three years and until a successor is appointed and qualified.
B. 
Appointments shall be made in such a manner that the terms of three members shall expire each year on the first Monday in February, and the terms of existing members may be changed to accomplish the purpose of this subsection. The Mayor shall from time to time designate one of the members as Chairman.
Any vacancy in the Office of Cultural Affairs' membership shall be filled for the remainder of the unexpired term in the same manner as the original appointment.
Any member of the Office of Cultural Affairs may be removed by the Mayor for cause, after charges have been preferred, reasonable notice thereof has been given to the member and a hearing has been held by the Mayor and City Council; provided, however, that a majority of the City Council shall approve such order of removal. The Mayor shall state in his order of removal to the member the reasons for said removal.
It shall be the duty and responsibility of the Office of Cultural Affairs to:
A. 
Promote the cultural affairs of the City of Marlborough.
B. 
Conduct studies and research and publish reports on cultural activities.
C. 
Cooperate with federal and state cultural agencies.
D. 
Advise municipal agencies on cultural matters.
E. 
Expend funds appropriated by the Mayor with the approval of the City Council for cultural projects, programs or activities in accordance with law.
F. 
Perform such other duties as may be prescribed by law.
There shall be an Executive Director of the Office of Cultural Affairs, who shall perform the administrative duties of the Office of Cultural Affairs, appointed by the Mayor, subject to the confirmation of the City Council.
A. 
The Executive Director of the Office of Cultural Affairs shall be appointed for a term of three years. Such term of the Executive Director shall commence after passage of this article and upon appointment by the Mayor.
B. 
The Executive Director shall be compensated for his services from moneys obtained by various functions sponsored by the Office of Cultural Affairs, funds obtained from the federal and state government or grants from various individuals or organizations; such compensation shall be at a rate to be determined by the Mayor and approved by the City Council.
The Executive Director of the Office of Cultural Affairs may be removed by the Mayor for cause, after giving the Director reasonable notice in writing of the reasons for removal and after a hearing has been held by the Mayor and City Council; provided, however, that a majority of the City Council shall approve such order of removal.
