The use and operation of illuminated outdoor flashing advertising signs is prohibited between the hours of 9:00 p.m. and 8:00 a.m. the following day.

A. 
No person, firm, association or corporation shall post, erect, display or maintain on any public way or on private property within public view from any highway, public park or reservation any advertising device that:
(1) 
Advertises or calls attention to any products, businesses or activities which are no longer sold or carried on.
(2) 
Advertises or calls attention to any nonexistent product, business or activity unless a permit to establish the same has been received from the proper authorities and construction is under way.
(3) 
Advertises hours of operation different from those actually followed.
B. 
This article shall be enforced by the Building Commissioner.

C. 
Notification to the owner of record of any violation shall be considered proper notification under the law.
D. 
The owner of the sign will have a period not to exceed 30 days to either correct the sign or to remove it from the premises.
E. 
Whoever violates any provision of this article shall be liable to a penalty of $20 for each day such violation continues to exist.
