The City Clerk, Chief of Police and Sealer of
Weights and Measures are hereby constituted a Board vested with the
authority to grant licenses under this article.
No person shall hawk or peddle meats, butter,
cheese, fish and fresh fruits or vegetables in the City until he has
obtained a license therefor from the Licensing Board; provided, however,
that this section shall not apply to any person who peddles only fruits
and vegetables or other farm products raised or produced by himself
or his family.
The Board created by §
468-1 shall have authority to grant such licenses to any person of good repute for morals and integrity who is or has declared his intention to become a citizen of the United States.
No license shall be issued until the applicant
has presented a certificate from the Sealer of Weights and Measures
to the effect that all weights, scales and measures to be used by
him in the sale of meats, butter, cheese, fish and fresh fruits or
vegetables have been tested and sealed according to law.
Every license issued under the provisions of
this article shall continue in effect for one year from the date of
its issuance.
The fee for every such license issued pursuant
to the provisions of this article shall be $1.
Every license issued pursuant to the provisions of this article may be revoked by the Board created by §
468-1 for violation of any of its terms.
Nothing in this article shall be construed as
conflicting with any license issued under the authority of the commonwealth.
Every licensee shall forthwith report to the
Licensing Board any change of drivers or other persons who may be
employed by him during the term of his license in the conveyance and
sale of meats, butter, cheese, fish and fresh fruits and vegetables.
Every vehicle or receptacle used by a licensee
as a conveyance for articles offered or exposed for sale by him shall
have attached thereto, on each outer side, a number plate, to be furnished
by the Sealer of Weights and Measures at cost, such number plate bearing
the number and date of expiration of such license.
Every licensee shall wear in a conspicuous place,
upon the outside of his outer garment, a badge showing the number
and date of expiration of his license, which badge shall be provided
by the Sealer of Weights and Measures at cost.
Meats, butter, cheese, fish and fresh fruits
and vegetables referred to in this article shall be so carried and
conveyed that they shall not tend to become a health nuisance. Such
articles shall be transported or carried only in vehicles or receptacles
which are neat and clean.
