Pursuant to the provisions of Section 17 of Article XX of Chapter 152
of the Laws of 1917, (N.J.S.A. 40:56-21) there hereby is created a general
Board to make all assessments for benefits accruing from local improvements
and to perform such other duties as are provided for by the statute in such
case made and provided. Such Board shall consist of three members to be appointed
by the Mayor and Council of the Borough of Leonia in the same manner as other
Borough officers are appointed. No person shall be appointed to said board
unless he shall be a resident, citizen and freeholder of the Borough of Leonia,
and, upon any member of said Board ceasing to be either a resident, citizen
or freeholder, his office shall become vacant. All appointments are made and
shall be for the calendar year and until a successor or successors are appointed.
Said Board herein provided for shall be known as "Commissioners of Assessment
of the Borough of Leonia."
Said Commission shall receive no salary but each Commissioner shall
be paid a minimum fee of $35 for each report of assessment submitted to the
Borough Council.
In improvements requiring an additional amount of time and skill on
the part of the Commissioners in arriving at the figures for the assessment
benefits either because of the size of the improvement of unusual conditions
in connection therewith, the Council may, by resolution, increase the fee
to be paid to each Commissioner to an amount that it believes to be fair compensation
for the work done in making the assessment. In no case, however, shall the
sum so determined to be paid exceed 1/2 of 1% of the total cost of the improvement
as certified to the Assessment Commissioners.
No more than one fee shall be paid said Commissioners for an assessment
under the same improvement ordinance.
All vacancies in said Board caused by death, removal or disqualification
by reason of ceasing to be a resident, citizen or freeholder of the Borough
of Leonia shall be filled for the unexpired term only.
Said Commissioners shall within 10 days after their appointment take
and subscribe an oath or affirmation that they will faithfully and impartially
discharge the duties of the office, which said oaths shall be filed with the
Borough Clerk who shall preserve the same.
