There is hereby established a Department of Public Works for the Borough
of Leonia. The Department of Public Works shall be under the general direction
of the Public Works Committee of the Council, subject to the control of the
Council and under the specific supervision of a Superintendent of Public Works,
who shall be appointed by the Mayor with the approval and consent of the Council.
The Superintendent of Public Works shall have such engineering training and
other qualifications as shall satisfy the Public Works Committee and the Council
of his fitness and competence to properly fulfill all the duties of his office.

It shall be the duty of the Superintendent of Public Works to supervise
the Public Works Department, keep and preserve carefully in such places as
may be designated by the Mayor and Council all maps made for or belonging
to the Borough of Leonia, prepare plans and maps of all public improvements
undertaken by the Borough, approve plans and maps of all public improvements
which may be privately undertaken under public supervision, prepare specifications,
contract forms and other forms involved in the taking of bids and the awarding
of work to contractors, supervise and inspect all construction work done by
the Borough, either directly or through contractors, on public improvements
undertaken by the Borough or on public improvements undertaken privately under
Borough supervision, keep accurate accounts of all expenditures made by his
Department and render regular reports thereof to the Council and give such
other engineering advice and information as may at any time be required by
the Mayor and Council.

The Superintendent of Public Works shall also be directly responsible
for the maintenance and repair of all public works, shall plan and supervise
the work of repair and maintenance of all streets and roads, carry on the
work of maintenance and care of public buildings, parks, grounds and equipment,
supervise the collection and disposal of garbage, ashes and waste, have general
supervision of all public sewers and stormwater drains, assume general charge
of all other work of repair, maintenance, minor construction and operation
of Borough equipment and shall perform such services in connection therewith
as shall be required or directed by the Mayor and Council.

The Superintendent of Public Works shall receive such salary as may
from time to time be fixed by the Council.

The employees of the Department of Public Works shall receive such monthly,
weekly or daily wages or compensation as shall be fixed, from time to time,
by the Superintendent of Public Works, subject to the approval of the Borough
Council. All employees in the Department shall be under the direct supervision
and control of the Superintendent of Public Works and may be discharged at
any time by him with the consent of the Mayor and Council or by resolution
of the Borough Council.
All salaries and wages of officers and employees of the Department of
Public Works shall be paid semimonthly by the proper officers of the Borough
out of such funds as may be appropriated for such purpose, provided that temporary
employees receiving a daily wage may in the discretion of the Mayor and Collector
be paid such wages as may be due more often than semimonthly, and upon discharge,
said employees shall be paid within three days thereafter.

The Superintendent of Public Works shall keep an accurate record of
the actual number of days spent by himself and/or his assistants, including
inspectors, on each public improvement hereafter undertaken in the Borough
of Leonia. The salary or wages of the Superintendent of Public Works and such
assistants or employees while so employed, together with disbursements for
plans and specifications for such improvements, shall be charged directly
against each respective improvement as engineering fees and shall be charged
and assessed against the persons benefited by such improvement in proportion
to the benefits received by them or each of them.

There are hereby established in the Borough of Leonia the positions
of Assistant Superintendent of the Department of Public Works and General
Foreman of the Department of Public Works, at salaries to be determined pursuant
to the Borough's Salary Ordinance. In the event that the position of
Superintendent of the Department of Public Works is temporarily vacated as
the result of illness or incapacity, the Assistant Superintendent shall temporarily
assume the position of Acting Superintendent. In addition to duties to be
determined by the Superintendent and/or the Borough Council, the General Foreman
shall be responsible for supervision over the collection operation that encompasses
garbage, trash and all recycling.

There is hereby established in the Borough of Leonia a table of organization
for the Department of Public Works, as set forth on Schedule A annexed hereto
and made a part hereof.
