The Mayor and Council may, from time to time,
on its own motion or on petition, after public notice and hearing,
by ordinance amend, supplement or change the regulations and districts
hereby established and adopt rules and regulations for the purpose
of carrying this chapter into effect.
In case of a written protest against any proposed
changes of a zoning district whereby any property would be relocated
in a different district, if such protest is signed by the owners of
20% or more either of the area of the lots included in such proposed
change or of those immediately adjacent thereto, on the same street
frontage or in the rear thereof, extending 100 feet therefrom or of
those directly opposite thereto extending 100 feet from the street
frontage of such opposite lots, such amendments shall not become effective
except by the favorable vote of 2/3 of the members of the Borough
Council.

A. Any owner, lessee, occupant, builder or other person who shall construct,
alter, repair, convert, maintain or use any building or structure
in violation of any provision shall, upon conviction, be punishable
for each such offense by imprisonment not to exceed 90 days or by
a fine not to exceed $2,000, or by both such fine and imprisonment,
and for such purpose, every period of 24 hours during which such violation
continues shall be deemed a separate offense.
B. In addition to all other sanctions, fines or penalties, any person
found in violation of any provision of the Zoning Code shall reimburse
to the Borough of Leonia all attorney fees and enforcement costs,
including, but not limited to, any costs of the Construction Code
Official or any other enforcement entity in enforcing this chapter,
court costs and/or filing fees.
C. In addition to all the foregoing and all other remedies available
to the Borough, the Borough Treasurer, upon appropriate notification
from the Mayor and Council (after appropriate certification from the
Enforcement Officer or the Borough Attorney), shall place a lien in
the amount of the total penalties, costs and assessments determined
by any court of competent jurisdiction. The lien placed upon such
lands shall be added to and form a part of taxes next to be assessed
and levied upon said lands, the same to bear interest at the same
rate as taxes, and to be collected and enforced by the same officers
and in the same manner as taxes.
The Mayor upon the recommendation of the Zoning
Officer, or the Mayor and Council by resolution, in addition to other
remedies, may institute any appropriate action or proceeding, in the
name of and on behalf of the Borough, to restrain, prevent, correct
or abate any violation or threatened violation of any provision of
this chapter.
