In this chapter when not inconsistent with the
context:
A. The word "lot" includes the word "plot" or "parcel."
B. Words in the present tense imply also the future tense.
C. The singular includes the plural and the plural includes
the singular.
D. The male gender includes the female gender.
E. The word "person" includes a partnership or corporation
as well as an individual.
F. The verb "shall" is mandatory.
G. The verb "may" is permissive.
For the purpose of this chapter, certain words
and terms used herein are defined as follows:
AS-BUILT
Drawings submitted upon completion of subdivision and prior
to dedication.
COMPREHENSIVE CODE ENFORCEMENT PLAN
The total complaint review, field inspection, training, recordkeeping
and information gathering efforts of the Code Enforcement Officer
of the Town of Chili as they relate to the on-going enforcement of
the New York State Uniform Fire Prevention and Building Code and all
provisions of the Code of the Town of Chili pertaining to any code
enforcement obligation or authority of the Code Enforcement Officer
of the Town of Chili or any authorized person acting in his place
or stead. This shall include but not be limited to information gathered
from his attendance at meetings or review of transcripts of meetings
of the Town Board, Planning Board or Zoning Board of Appeals or any
other Town records, which bring to his attention problems pertaining
to certain areas of Town or certain tracts or parcels of land. The
goal of the Comprehensive Code Enforcement Plan is compliance with
the New York State Uniform Fire Prevention and Building Code and all
provisions of the Code of the Town of Chili.

CONDITIONAL APPROVAL OF A FINAL PLAT
Conditional approval by a Planning Board of a final plat
is the approval of a final plat subject to conditions set forth by
the Planning Board in a resolution conditionally approving such plat.
Such conditional approval does not qualify a final plat for recording
nor authorize issuance of building permits prior to the signing of
the plat by a duly authorized officer of the Planning Board and recording
of the plat in the office of the Monroe County Clerk or register in
accordance with provisions of this article.
COUNTY MASTER PLAN
A comprehensive plan for the development of Monroe County
prepared by the Monroe County Department of Planning and as may be
adopted in part or in its entirety by the Monroe County Legislature
pursuant to Section 706 of the County Charter.
COUNTY OFFICIAL MAP
A map established by the Monroe County Legislature, pursuant
to §§ 239-g, 239-h and 239-i of the General Municipal
Law.
DIVISION
When used in the context of the definition of subdivision,
the sale, transfer, lease, rental or the devise by will of land.
EASEMENT
Authorization by a property owner for the use by another
person, Town, municipality or public utility district of any designated
part of his property for a specified purpose.
ENGINEERED SUBDIVISION
A subdivision plat which received the approval of the Town
of Chili Planning Board, which was signed by the Town of Chili Engineer
and was filed in the office of the Monroe County Clerk in the Book
of Maps.

FLOOD LIMITS
The land-water boundary of a natural watercourse flowing
at a frequency defined by a responsible agency such as the United
States Army Corps of Engineers, the Soil Conservation Service of the
United States Department of Agriculture, the Monroe County Department
of Planning or the Monroe County Department of Public Works or their
successors.
MAJOR SUBDIVISION
Any division of land which is not a minor subdivision.

MINOR SUBDIVISION
A division of land, which is zoned and whose uses are exclusively
residential and/or agricultural, and which does not require the construction
or extension of a street or public utility and which is:

A.
A resubdivision where up to two contiguous lots
are combined into one lot by the removal of a common lot line(s);
B.
A resubdivision of up to two contiguous lots
where a common boundary line(s) is altered and where the resulting
two resubdivided lots comply with the Zoning Chapter; or
C.
A subdivision, other than the resubdivision described in Subsections
A and
B above, containing two or fewer lots, where each lot complies with the Zoning Chapter.
ONE-LOT MINOR SUBDIVISION
A minor subdivision consisting of 20 acres or more, as shown
on the official assessment role of the Town of Chili and containing:

A.
One fully surveyed lot for a proposed residential
building site; and
B.
Remaining lands which consist of the lot where
the resubdivision applicant did not submit a complete instrument survey
for said lot.
OPEN SPACE INDEX
The Town of Chili's Open Space Index as adopted and amended
by the Town Board.
PARCEL
Land identified by a legal description and tax account number
which is filed or proposed to be filed in the County Clerk's office.
PRELIMINARY PLAT
A drawing prepared in accordance with §
439-31 of this chapter showing the approximate manner in which a tract of land is proposed to be subdivided and including preliminary design data for related improvements. This is identical to the "preliminary plat" referred to in § 276 of the Town Law.
REMAINING LANDS
In a one-lot minor subdivision, the lot containing lands
which were not fully surveyed and shown as "remaining lands."

RESERVATION FOR HIGHWAY PURPOSES
A strip of land between the existing right-of-way line and
the future right-of-way line of a highway as determined by the agency
having jurisdictional responsibility over the maintenance and construction
of the highway. Where a reservation is required, the front lot line
shall be considered to be coincident with the existing right-of-way
line, with front setbacks and any other necessary lot measurements
being measured from the existing right-of-way line.
STREET
A right-of-way for vehicular traffic, whether designated
as a street, highway, thoroughfare, parkway, road, avenue, boulevard,
lane, place, alley or however otherwise designated, but not including
a private driveway serving a single property. Whenever a street serves
more than one of the uses defined below, standards of the higher classification
shall apply.
A.
ARTERIAL STREETSStreets which are used or designed primarily for through or heavy traffic.
C.
MINOR STREETSStreets which are used primarily for access to the abutting properties.
D.
MARGINAL ACCESS STREETSMinor streets which are parallel to and adjacent to arterial streets, and which provide access to abutting properties and protection from through traffic.
F.
ALLEYSMinor rights-of-way which are used primarily for vehicular service access to the back or the side of lots otherwise abutting on a street.
SUBDIVIDER
The owner(s) of the land from which the proposed subdivision
is being created or his (their) agent(s).
SUBDIVISION
The division of a parcel of land into two or more lots, blocks,
parcels or sites with or without streets or highways. The term includes
resubdivision and, when appropriate to the context, shall relate to
the process of subdividing or to the land subdivided.
SUBDIVISION PLAT
Drawings prepared in accordance with §
439-32 of this chapter showing definitively a proposed subdivision of a tract of land and plans for related improvements.
TOWN ENGINEER
A licensed professional engineer retained by the Town on
a consulting or full-time basis.
TOWN MASTER PLAN
A comprehensive plan for the development of the Town prepared
by the Planning Board pursuant to § 272-a of the Town Law.
TOWN OFFICIAL MAP
A map established by the Town Board of the Town of Chili
pursuant to §§ 270 and 273 of the Town Law, or additions
thereto resulting from the approval of subdivision plats by the Planning
Board and the filing of such plats pursuant to § 279 of
the Town Law.
