No person shall indulge in disorderly, noisy
or disturbing conduct within the Village. Any person who commits any
of the following acts will be considered in violation of this article
if said person:
A. Uses or indulges in offensive, disorderly, threatening,
abusive or insulting language, conduct or behavior.
B. Acts in such a manner as to annoy, disturb, interfere
with, obstruct or be offensive to others.
C. Congregates with others on a public street, sidewalk,
park or place for other than a lawfully permitted purpose and refuses
to move on when ordered by the police, code enforcement officers,
appearance ticket officers or other lawful authority.

D. Except when lawfully addressing others, by his actions
causes a crowd to collect, shouts or makes any other noise, either
outside or inside a building, during the nighttime to the annoyance
or disturbance of any considerable number of persons.
E. Interferes with any person in any place by jostling
against such person or unnecessarily crowding him or by placing a
hand in the proximity of such person's pocket, pocketbook or handbag.
F. Stations himself on the public streets or follows
pedestrians for the purpose of soliciting alms, or soliciting alms
on the public streets unlawfully.
G. Maintains any house of prostitution, gambling house
or place where, by means of a slot machine, faro bank, dice or other
implements of gambling, money, liquor or any other articles may or
shall in any manner be played for or be found within such place.
H. Damages, destroys or makes improper or unauthorized
use of any Village property, including parks, streets and sidewalks,
or places or conducts himself in a manner contrary to any notices,
rules or regulations of the Village, or refuses to obey the orders
of any person or persons in authority with respect to the use of or
conduct in or with respect to such property.
I. Engages in throwing or propelling stones, missiles,
snowballs or other objects, or engages in any act or amusement or
practice endangering property or persons on Village property or on
or in Village streets, sidewalks, park or places.
J. Discharges within the Village any toy pistols, firecrackers,
bombs or other noisemaking devices or engages in the operation of
any noisemaking device; provided, however, that the Board of Trustees,
in its discretion and upon proper written application therefor, may
suspend the operation of this subsection under such conditions and
restrictions as it may deem proper to impose. But nothing herein contained
shall be determined to authorize at any time when the operation of
this subsection shall be so suspended any conduct within the Village
which shall endanger life or property.

K. Operates without a written permit from the Board of
Trustees in or upon any vehicle or in any building or upon any premises
or in any street, park, sidewalk or other public place in the Village
of Port Jefferson any voice-amplifying device, radio device or mechanical
or manual instrument or device of any kind whereby the sound therefrom
is cast directly upon the public streets and places, where such device
is maintained and operated for advertising purposes or for the purpose
of attracting the attention of the passing public or which is so placed
and operated that the sounds coming therefrom can be heard to the
annoyance or inconvenience of travelers upon any street or public
place or of persons in neighboring premises.
L. Skates, propels oneself or another, rides a bicycle,
unicycle, moped, skateboard, go-cart, snowmobile, minibike or any
other recreational vehicle on a public highway, street or sidewalk,
park or recreational area, parking field or public property in an
unsafe manner, the operation of which impedes or causes vehicular
traffic to take evasive action due to the presence of the above vehicle
or which interferes with or endangers pedestrians and/or endangers
his own well-being.

M. Smokes any cigar, cigarette, or other material, or
smokes, vapes, or ingests cannabis, as defined in Section 222.00 of
the Penal Law, within the confines of any Village building, park,
beach or other Village property, except the golf course, will be subject
to the policies and procedures promulgated by the CCMAC.

Any person who violates this article or fails to comply with any of its requirements shall, upon conviction thereof, be subject to the penalties provided in §
1-2 of the Code of the Village of Port Jefferson.
