The Board of Trustees of the Incorporated Village
of Port Jefferson, being cognizant of the hazards presented by the
spillage or leakage of waste oil and other petroleum products, and
further being cognizant of the importance of protecting and preserving
natural resources, hereby deems it necessary and essential to regulate
and control the handling, storage and disposition of waste oil and
other petroleum products.
As used in this article, the following terms
shall have the meanings indicated:
CONTAINER
A metal container with a screw cap or other device for closing
which prevents liquid or gases from escaping from the container.
DRUM
A metal barrel, having a capacity not in excess of 55 gallons,
with a screw cap or other device for closing which prevents liquid
or gases from escaping from the drum.
OIL SEPARATOR
A device or apparatus which is connected or attached to a
drain for the purpose of preventing oil or other petroleum products
from flowing into a sewer, disposal system or the ground.
REPAIR SHOP
Any location where the business of mechanical maintenance
work, repair or replacement of parts on engines or mechanisms using
petroleum products is carried on, regardless of whether the engine
or mechanism on which the work is being performed is designed for
automotive, marine, home garden and lawn or other use.
SERVICE STATION
Any location or property where flammable or combustible liquids
used as motor or engine fuels are stored and dispensed from fixed
equipment into the fuel tanks of motor vehicles and where services
for the changing of motor oil may be provided.
STORAGE TANK
A below-ground or aboveground tank approved, both with regard
to construction and location, by the Fire Inspector of the Village
of Port Jefferson.
WASTE OIL
Any oil which has been drained or removed, either before
or after having served its primary purpose, from the reservoir wherein
it was contained during the performance of its primary purpose.
It shall be unlawful for any person to drain
any waste oil or other petroleum product from a motor vehicle, machine,
conveyance or equipment unless it is deposited, either directly or
indirectly, into a container, drum or storage tank as defined above.
It shall also be unlawful for any person to permit, sanction or condone
any condition which allows any such oil or petroleum product to leak,
drain or spill on any ground, pavement or roadway or to discharge
or seep into any sewer, leaching pool, stream, lake, well or other
body of water. This section shall not be construed to render unlawful
a condition wherein no more than a few drops of oil drip from the
underside of a car, truck or other machine in any one day but shall
be construed to prohibit spillage or leakage from such cars, trucks
or other machines.
The owner or operator of any service station
or repair shop shall provide and install oil separators or traps to
prevent waste oil and petroleum product spillage from flowing into
any sewage disposal system, leaching pool, stream, lake, well, other
body of water or into the ground. Contents of oil separators or traps
of floor drainage systems shall be collected at sufficiently frequent
intervals to prevent oil from flowing into any of the above-mentioned
places. Oils or petroleum products recovered from the oil separator
or trap shall be removed and disposed of or stored as hereafter required.

Any person who violates this article or fails to comply with any of its requirements shall, upon conviction thereof, be subject to the penalties provided in §
1-2 of the Code of the Village of Port Jefferson.
