This chapter shall be known and cited as the "Prohibition Against Littering
Law."
This chapter is enacted for the purpose of providing for the peace and
order of the Village of Fultonville and the preservation of the health and
safety of the inhabitants thereof.
No person shall hereafter throw, place or deposit or cause to be thrown,
placed or deposited any trash, garbage, empty containers, empty bottles, junk,
papers, leaves, clippings or litter of any kind or nature in or on any public
area or public sidewalk in the Village of Fultonville, New York.
Nothing herein contained shall be construed to prohibit the placing
of such material in containers placed upon the public sidewalk for collection
of such material nor shall it be construed to prohibit the placing of such
material upon the public sidewalk in approved containers for the purpose of
making it available for collection of refuse and garbage by any public or
private collection service.
Any person violating the provisions of this chapter will be guilty of
an offense and, upon conviction thereof, shall be punishable by a fine of
not more than $250 or imprisonment for not more than 15 days, or both such
fine and imprisonment. Each days' continuation of the offense shall be
considered a separate offense.
