The following are the provisions of the Brookville Borough Zoning Ordinance. This chapter is the Brookville Borough Zoning Ordinance.
This chapter shall take effect 30 days after enactment.
Amendment, revision and reenactment of the Zoning Ordinance of the Borough adopted as Ordinance No. 27, ordained and enacted into law on June 29, 1972, as amended. Since this chapter is self-contained, Ordinance No. 27 and all amendments thereto will be repealed as hereinafter provided.
The enactment of this new Zoning Ordinance may neither require nor allow for the completion of a new Comprehensive Plan and approval of new community development goals and objectives. These matters will have to be considered at a later date when circumstances shall so dictate.
A map entitled "Official Zoning Map" of Brookville Borough, Jefferson County, Pennsylvania, dated July 2005, is hereby adopted as part of this chapter. The Zoning Map shall be kept on file for examination in the Municipal Building. In addition, the map shall be updated after any future zoning district boundary changes are made and enacted by the Borough Council.
No structure shall be located, erected, constructed, reconstructed, moved, altered, converted, or enlarged, nor shall any structure or land be used or designed to be used, except in full compliance with all the provisions of this chapter and after the lawful issuance of all permits and certificates required by this chapter.
If any provision of this chapter or the application of any provision to particular circumstances is held invalid, the remainder of the chapter or the application of such provision to other circumstances shall not be affected.
Where literal compliance with the standards and requirements of this chapter is clearly impractical, the Borough Council may modify or adjust the standards or requirements to permit reasonable utilization of property while securing substantial conformance with the objectives of this chapter. When any such modifications or adjustments are approved, the Borough Council shall make written findings with the assistance of the Borough's selected professional consultants, which findings shall be made a part of the public record.
