This chapter may be known and cited as the "Silverdale Nuisance Ordinance."
Certain words and phrases used in this chapter shall have the meanings ascribed as follows:
ABANDONED VEHICLE
Any motor vehicle which has a defaced, changed, or obliterated serial number, or any mobile vehicle which is parked or stored on a public road or property not owned by the owner of the vehicle or which is parked or stored on private property or a public road or property without having a current license or a current inspection sticker.
DANGEROUS STRUCTURE
Any building which has deteriorated to the state where it is dangerous and unsafe for human occupancy, constitutes a fire hazard, endangers surrounding buildings, shelters rats or other vermin, or endangers the safety of children playing thereabout.
GARBAGE
Animal, vegetable and organic waste, from the handling, preparation, cooking and consumption of food.
JUNKED VEHICLE
Any mobile vehicle which has been stripped, damaged, or is in such a state of disrepair that it has no value except for junk or salvage, or any vehicle without a current license or current inspection sticker not stored within a garage.
PERSON
An individual, partnership or corporation.
RUBBISH
All waste and discarded materials having only a junk or salvage value.
The following conduct is hereby declared to be a nuisance, to be unlawful and prohibited under the provisions of this chapter:
A. 
The accumulation of ashes, garbage, rubbish and other refuse material.
B. 
The throwing, dumping, or depositing, or causing to be thrown, dumped or deposited, of any glass, metal, garbage, wastepaper or rubbish of any kind, either from a vehicle or otherwise, in, upon or along any public road or highway within the Borough of Silverdale.
C. 
The throwing, dumping, or depositing, or causing to be thrown, dumped or deposited, of any glass, metal, garbage, wastepaper or rubbish of any kind, either from a vehicle or otherwise, in or upon the land of another located within the Borough of Silverdale.
D. 
Permitting or allowing the spread or dissemination of loose debris, by wind, water or otherwise, upon the public roads or highways or upon the lands of another.
E. 
The storage of junked vehicles, except within a closed building.
F. 
Owning or controlling an abandoned vehicle.
G. 
Owning or controlling a dangerous structure.
A. 
In the event that any of the conduct defined and prohibited in this chapter shall become known, the Borough Council shall order that the conduct or condition be discontinued or removed upon 15 days' written notice. Upon default, the Borough Council may cause the removal of any nuisance described under § 223-3 hereinabove and collect the cost thereof, together with a penalty of 10% of such cost, in the manner provided by law for the collection of municipal claims, or by civil action at law, or may seek relief by an action in equity.
B. 
Notwithstanding the above, any person violating the provisions of this chapter shall be subject to a fine of not more than $600 for each separate offense, provided that each day's continuance of a violation of any of the provisions of this chapter shall constitute a separate offense. In default of payment of such fine, the defendant may be imprisoned for a period not exceeding 30 days.[1]
