As used in this chapter, the following terms shall have the meanings indicated:
OUTDOOR SWIMMING POOL
A body of water in an artificial or semiartificial receptacle or other container, whether constructed or placed above or below the ground, used or intended to be used for public, semipublic, or private swimming by adults or children, or both adults and children.
An outdoor swimming pool shall be completely surrounded by a fence or wall not less than four feet in height at any point from the ground level. The fence or wall shall be so constructed as to have openings not larger than five inches horizontally, except for doors and gates. A dwelling house or accessory building may be used as part of such wall or fence.
All gates or doors opening through the fence or wall shall be equipped with a self-closing or self-latching device for keeping the gate or door securely closed at all times. When the swimming pool is not being used, such gate or door shall be locked.
This chapter applies to all outdoor swimming pools with a minimum depth of 24 inches of water, whether constructed, placed or maintained before or after enactment of this chapter.

Any person, firm or corporation who or which shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $600, and costs of prosecution, or, in default of payment of such fine and costs, to undergo imprisonment for not more than 30 days.
