The lot or yard requirements for any new building
or use shall not include any part of a lot that is required by any
other building or use to comply with the requirements of this chapter.
No required lot or area shall include any property, the ownership
of which has been transferred subsequent to the effective date of
this chapter, if such property was a part of the area required for
compliance with the dimensional requirements applicable to the lot
from which such transfer was made.
Where a minimum lot size is specified, no primary building or use shall be erected or established on any lot of lesser size than as specified in §
340-19 and/or §
340-32 of this chapter. Reference is also made to Article
IX, Nonconformities, where applicable.
Where a minimum lot width is specified in §
340-19 and/or §
340-32 of this chapter, no building shall be erected on any part of a lot which has a width less than that specified in §
340-19 and/or §
340-32, except as specified in this section.
If the alignment of existing buildings on either
side of a lot within a distance of 50 feet of the proposed building
and fronting on the same side of the same street in the same block
is nearer to the street than the required front yard depth, the Borough
Council may accept the average of such existing alignment within that
distance as the required front yard, but in no case shall the front
yard be less than 20 feet.
Ground-story bays, porches, and chimney flues
may project into required yard area no more than four feet. Such projections
shall not occupy more than 1/3 of the length of the building wall.
Cornices and gutters may project not more than two feet over a required
yard. Fire escapes may be permitted in accordance within this section
in side or rear yards only.
The yard requirements shall not apply to fences,
hedges, or walls less than six feet in height above the natural grade,
nor to terraces, steps, uncovered-unenclosed porches, nor to similar
features less than three feet above the level of the floor of the
ground story.
Maximum height regulations shall not apply to
farm buildings, church spires, chimneys, or other structures built
above the roof and not devoted to human occupancy.
On a corner lot, the street side yard shall
equal the required front yard for lots facing that street.
All uses, activities, subdivisions and/or land
developments proposed within Silverdale Borough shall comply with
the Table of Dimensional Requirements set forth in the following section.
The standard in the Table of Dimensional Requirements
shall apply in the specific districts, and all requirements must be
met for the district. These standards may not be as restrictive as
other sections of this chapter; the more-restrictive shall always
govern.
