[HISTORY: Adopted by the Common Council of the City of Mayville 2-13-1989 by Ord. No. 695-89 as Ch. 4 of the 1989 Code. Amendments noted where applicable.]
The Police Department of the City shall consist of the Chief of Police and such subordinates as the Council may designate.
A. 
Police Chief. See Chapter 105, § 105-2 of this Code.
B. 
Subordinates. Subordinates shall be appointed in accordance with § 62.13, Wis. Stats.
The salaries of the Chief of Police and subordinates shall be fixed by the Council but shall not be decreased without a previous recommendation from the Police and Fire Commission.
Disciplinary action against the Chief of Police and subordinates shall be in compliance with § 62.13(5), Wis. Stats.
A. 
The Chief of Police shall be the chief executive officer of the Department and shall have direct control and management of all of its members in the lawful exercise of their duties.
B. 
The Chief shall prescribe written rules and regulations for the operation of the Police Department, subject to Council approval.
C. 
The Chief shall be responsible for the maintenance of order, the enforcement of laws and the ordinances and regulations of the City, the prevention of crime and the protection of life and property.
D. 
He shall maintain rigid discipline so as to secure complete efficiency in the Department.
E. 
The Chief shall attend Public Safety Committee meetings, Police and Fire Commission meetings and Council meetings, upon request.
A. 
General powers and duties. Each officer of the Department shall possess the powers conferred on marshals and constables by law, shall preserve the public peace and shall enforce the laws and ordinances of the state and City subject to the orders, rules and regulations of the Chief.
B. 
Power of arrest. The Chief of Police and any police officer shall arrest all persons in the City found in the act of violating any law or ordinance of the City or state or aiding or abetting in such violation, and they may arrest without warrant all persons who they have reasonable grounds to believe have violated any law or ordinance and who will not be apprehended unless immediately arrested, shall take all arrested persons in custody and confine them, and shall, within a reasonable time, bring such persons before the court having jurisdiction thereof to be dealt with according to law.
C. 
Reporting dangerous conditions. The Chief of Police and any police officer shall report all street and sidewalk obstructions, unlighted streetlamps, unlawful street signs or signals and defective or dangerous streets and sidewalks to the Director of Public Works.
D. 
Assisting Fire Department. Whenever necessary, any police officer shall assist the Fire Department in maintaining order at the scene of a fire.
E. 
Permits and licenses. The police officers shall ensure that the necessary permits and licenses issued by the state or the City are in the possession of or are properly displayed by any person engaged in an activity or business within the City for which a permit or license is required and that the terms of such license or permit are complied with.
The Chief of Police shall prepare rules for the administration of the Police Department, which rules shall be in full force upon approval of the Council.
In accordance with § 66.0313, Wis. Stats., and policies established by the Council, the Chief of Police may respond to requests for police personnel from other governmental entities and may request said jurisdiction to provide police personnel to the City.

In compliance with § 66.0502, Wis. Stats., the Chief of Police and Police Captain shall reside within 15 miles of the jurisdictional boundaries of the City of Mayville.

Background checks shall be conducted through the Mayville Police Department of applicants for City employment, applicants for volunteer positions and applicants for licenses issued by the City as requested by department heads and City personnel. All background checks need to be directed to the Chief of Police at time of request. No teletypes will be released from the Mayville Police Department premises.[2]

A. 
Warrant fee. Pursuant to the provisions of §§ 814.70, 814.705 and 814.71, Wis. Stats., if the Police Department serves a warrant or a commitment order upon an individual, a fee for the service of said warrant or commitment shall be set by the Common Council.
