It is unlawful for any person to have or maintain a barbwire or electrified fence along or near any sidewalk, street, or public place within the City of Parsons. Any person violating this section shall be notified by the City to remove the fence within 24 hours after notice to do so from the City. A person violating this section shall be guilty of a Class C misdemeanor and subject to a penalty as provided in §
1-2 of this Code, and each day the violation shall continue shall be a separate offense.

A. No fence or wall shall be built or maintained on any
lots in the City which is more than four feet in height in the front
yard or more than six feet in height in the side or rear yard; provided,
however, that a fence which is not more than 25% of solid or unopen
construction may be constructed to any height. The terms "front yard,"
"side yard" and "rear yard" shall be defined for the purpose of this
section as they have been defined in the City Zoning Regulations.
B. This section shall not apply to fences or walls located
on or inside the required building setback line for the lot.
C. The height limitation for a fence or wall in a side
yard on a corner lot shall be no more than four feet in height in
the required front and rear yard setback and no more than six feet
in height otherwise, provided that the height may be six feet in the
rear yard setback where no alley is platted.
D. The height limitation for a fence or wall in a side
interior lot shall be no more than four feet in height in the required
front yard setback and no more than six feet in height otherwise.
E. Violation of this section shall constitute a Class C misdemeanor, punishable as provided in §
1-2 of this Code.

A. A permit shall be required whenever erecting a new fence or retaining
wall, extending an existing fence or wall, or replacing more than
50% of an existing fence within the City. A fence permit application
must be completed, submitted to the Building Inspector and approved
prior to the commencement of erecting a fence. There shall be no fee
charged to obtain a fence permit. A permit will be issued if the proposed
fence meets all applicable zoning regulations, requirements of the
applicable building code and requirements of the Parsons City Code.
It shall be unlawful to erect a fence without a permit. A person or
entity violating this section shall be guilty of a Class C misdemeanor
and subject to a fine of $50 and not more than 10 days in jail if
the fence constructed without a permit meets all applicable zoning
regulations, requirements of the applicable building code and requirements
of the Parsons City Code. In the event the constructed fence does
not meet the applicable zoning regulations, requirements of the applicable
building code or requirements of the Parsons City Code, the applicable
fine shall not be less than $1,000 unless the fence becomes compliant
by a deadline set by the municipal court judge. In the event the fence
becomes compliant by said deadline, the fine shall be reduced to $50.
The City reserves the right to also pursue any and all civil remedies,
including injunctive relief, in addition to the penalties and provisions
contained herein.
B. A fence shall be defined as a freestanding structure of metal, masonry,
glass, plastic or wood or any combination thereof, resting on or partially
buried in the ground and rising above ground level, and used for confinement,
screening or partition purposes, but which does not pose a threat
to public safety or health.
