The Minnesota State Building Code, as adopted by the Commissioner of Labor and Industry pursuant to Minn. Stat. § 326B.01 et seq., including all of the amendments, rules and regulations established, adopted and published from time to time by the Minnesota Commissioner of Administration, through the Department of Labor and Industry, is hereby adopted by reference with the exception of the optional chapters, unless specifically adopted in this article. The Minnesota State Building Code is hereby incorporated in this article as if fully set out herein.

The application, administration, and enforcement of this code shall be in accordance with Minnesota State Building Code. The code shall be enforced within the territorial limits of the City of Isanti, and within the extraterritorial limits permitted by Minn. Stat. § 326B.121, Subd. 2(d), as amended from time to time. The code enforcement agency of this municipality is called the "Community Development Department." This code shall be enforced by a Minnesota Certified Building Official designated by this City to administer the code pursuant to Minn. Stat. § 326B.133, including plumbing plan review and inspections. The Minnesota State Building Code shall govern permit applications except that in addition each application shall describe the land by certified survey on which the proposed work is to be done by lot, block, tract, and house and street address or similar description that will readily identify and definitely locate the proposed building or work. Prior to installation of a system of plumbing other than for a single-family dwelling with independent plumbing service, complete plumbing plans and specifications, together with any additional information that the Building Official may require, shall be submitted in duplicate and approved by the Building Official. No construction shall proceed except in accordance with the approved plans. Any alteration or extension of any existing plumbing system shall be subject to these same requirements. A plumbing system installation, as described herein, shall be subject to inspection as required by the State Plumbing Code. Fees for Plumbing Plan Review shall be as specified for plan review in City Code.
A. 
The issuance of permits and the collection of fees shall be as authorized in Minn. Stat. § 326B.121, Subd. 1.
B. 
Permit fees shall be assessed for work governed by this code in accordance with the fee schedule in effect at the time. In addition, a surcharge fee shall be collected on all permits issued for work governed by this code in accordance with Minn. Stat. § 326B.148.

C. 
Fee refunds. The Building Official may authorize refunding of any fee paid hereunder which was erroneously paid or collected.

Requests for refunds must be in writing and signed by the permit holder. The Building Official will review the request for refund and make a determination to approve or deny the request. The City shall retain the following as described in the table below:

(2) 
No refunds will be approved or granted after 180 days from the date the permit was issued. No refunds will be approved or granted for the following: plan review fees, state surcharge fees, reinspection fees, and any other services that have previously been rendered.
A violation of the code is a misdemeanor (Minn. Stat. § 326B.082 et seq.).
A. 
The Minnesota State Building Code, established pursuant to Minn. Stat. § 326B.01 et seq., allows the municipality to adopt by reference and enforce certain optional chapters of the most current edition of the Minnesota State Building Code.
B. 
The following optional provisions identified in the most current edition of the State Building Code are hereby adopted and incorporated as part of the Building Code for this municipality.

Appendix J (Grading) from the 2018 International Building Code.
