The following words, terms and phrases, when
used in this chapter, shall have the meanings ascribed to them in
this section, except where the context clearly indicates a different
meaning:
DISTRIBUTOR
Any person selling fireworks to wholesalers and retailers
for resale.
FIRE CHIEF
The Chief of the Fire District or Fire Agency.

LEGAL FIREWORKS
Wire or wood sparklers of not more than 100 grams of mixture
per item, other sparkling items which are nonexplosive and nonaerial
and contain 75 grams or less of chemical mixture per tube or a total
of 200 grams or less for multiple tubes, snakes, and glow worms, smoke
devices, or trick noisemakers which include paper streamers, party
poppers, sting poppers, snappers, and drop pops, each consisting of
not more than 0.25 grains of explosive mixture.
MANUFACTURER
Any person engaged in the manufacture of fireworks.
RETAILER
Any person purchasing fireworks for resale to consumers.

Nothing in this chapter shall prohibit wholesalers,
distributors, importers, specialty retailers, or manufacturers from
storing, selling, shipping, or otherwise transporting fireworks to
any person outside the City.

Any person violating this chapter shall be guilty
of a petty misdemeanor upon the first offense (punishable by a fine
of not to exceed $300) and a misdemeanor upon the second and subsequent
offenses (punishable by a fine not to exceed $1,000 or a prison term
of not to exceed 90 days, or both, plus costs of prosecution in either
case).
