A. There is hereby established in the Township the office
of Purchasing Agent. The Purchasing Agent shall have the authority,
responsibility, and accountability as the Township's contracting agent
for the purchasing activity for the Township in accordance with this
section and the Purchasing Manual dated June 18, 2002, and approved
by the Mayor and Council on June 26, 2002, and as amended from time
to time ("Purchasing Manual"). The Purchasing Agent is hereby granted
the authority to:
(1) Prepare public advertising for bids and receive bids
for the provision or performance of goods and services on behalf of
the Township;
(2) Award contracts not exceeding the bid threshold as
permitted by N.J.S.A. 40A:11-3a in the name of the Township;
(3) Award contracts that are in the aggregate less than
15% of the bid threshold without soliciting competitive quotations;
and
(4) Conduct any activities as may be necessary or appropriate
to the purchasing function of the Township.
B. All purchases of or contracts for the furnishing of
any supplies, labor, materials, equipment, services or other matters
for a department shall be made in accordance with the Purchasing Manual
and the applicable requirements of New Jersey statutes relating to
the public contracts for purchases, contracts and agreements.
C. The bid threshold in the Township shall be the maximum
amount authorized by the Legislature in N.J.S.A. 40A:11-3a, as amended
from time to time. In the event the Purchasing Agent is qualified
pursuant to N.J.S.A. 40A:11-9b, by resolution the Mayor and Council
may increase the bid threshold up to the higher maximum amount permitted
by the Legislature by N.J.S.A. 40A:11-3a, as amended from time to
time.
