[Adopted 7-8-1975 by L.L. No. 1-1975 (Ch. 54, Art. II, of the 1975 Municipal Code)]
Any dog running at large, contrary to the provisions of Article I, Dog Control; Running at Large, of this Chapter 192 of the Code of the Town of Southport, as amended, shall be subject to seizure and impounding by any enforcement officer or special Town policeman, or by any other person or agency designated by the Town of Southport authorized by law to seize and impound such dogs.
The Town of Southport shall make suitable arrangements by contract or otherwise for the impounding, and, in the proper case, for destruction of dogs running at large within the Town of Southport in violation of this article.

After any such seizure and impounding the owner of such dog shall be so notified, if the owner's whereabouts can be ascertained, and said owner shall have the right to redeem such impounded dog as provided in Article I, Dog Control; Running at Large, of this Chapter 192 of the Code of the Town of Southport, as amended, upon the payment of such further expenses as may have been incurred by the Town of Southport in contracting for the impoundment thereof which shall consist, among other things, of established fees, as set forth in Agriculture and Markets Law § 117, Subdivision 4, or pursuant to any contract for enforcement.
If any dog so impounded is not redeemed as provided by the Code of the Town of Southport, as amended, or any contract entered thereunder, and the provisions of the Agriculture and Markets Law of the State of New York within the time prescribed therein, such dog may be destroyed in accordance with the provisions of the Agriculture and Markets Law of the State of New York, as amended.
The owner of any dog so impounded who fails or refuses to redeem such dog shall be subject to a penalty for the costs of such impounding as hereinbefore set forth to be recovered in a civil action in the name of the Town of Southport, unless provided otherwise by contract, against such owner in the Justice Court of this Town.
