Tires having treads designed for use in snow, which tires shall be in such condition as to serve the purpose for which they are designed. A "mud and snow passenger tire" means a tire which, when compared with a conventional rib type, is designed primarily to provide additional starting, stopping and driving traction in mud and snow. The tread has ribs, lugs, blocks or buttons, is generally discontinuous and has the following marking and characteristics when inflated:

A substantial portion of the lug, block or rib edges in the tread design are at an angle greater than 30° to the time circumferential center line.

On at least one side of the tread design, the shoulder lugs protrude at least 1/2 inch in a direction generally perpendicular to the direction traveled.

Tires manufactured after January 1, 1976, shall be permanently labeled on one sidewall with the words "Mud/Snow" or any contraction using the letters "M" and "S", such as MUS, M/S, M&S, etc.

SNOW

Any precipitation depositing any accumulation on the streets, including snow, sleet, hail, ice and freezing rain.

SNOW EMERGENCY

A state of highway condition that is hazardous and dangerous to vehicular and pedestrian traffic and is so declared by the Mayor.

SNOW EMERGENCY ROUTES

Streets in the City so designated and marked.

VEHICLES

All self-propelled motorized vehicles using City streets and highways, excluding public transportation conveyances.

§ 560-32 Declaration of snow and ice emergency.

In order to facilitate the movement of traffic and to combat the hazards of snow and ice on the snow emergency routes named in § 560-34, the Mayor in his discretion may declare a snow and ice emergency, designated in this article as a "snow emergency." The Mayor may declare any snow emergency route or any part of a snow emergency route to be free from restrictions herein imposed when, in his opinion, the weather or street conditions warrant such an exclusion. Information on the existence of a snow emergency may be given by the City through radio, newspaper or other available media, and information on the termination or modification of the emergency may be given by use of the same media.

§ 560-33 Parking and driving restrictions on snow emergency routes.

After any snow emergency is declared, it shall be unlawful at any time during the continuance of the emergency for any person:

To park or leave unattended a motor vehicle or to allow that vehicle to remain parked or unattended anywhere on any snow emergency route designated in § 560-34; or

To drive any motor vehicle on any such snow emergency route, unless that vehicle is equipped with snow tires, chains, all weather tires or studded tires that are approved by the commonwealth.

§ 560-34 Snow emergency routes designated.

The following are designated as snow emergency routes:

§ 560-35 Emergency towing.

Any vehicle parked, stalled, incapable of moving under its own power or left unattended upon any street designated as a snow emergency route may be removed or towed to any other location by the Police Department at the owner's expense.

§ 560-36 Other prohibited parking.

Nothing in this section shall be construed to permit parking at any time or place where it is forbidden by other provisions of the law.

§ 560-37 Limited snow and ice emergency.

The Mayor, in his discretion, may declare a limited snow and ice emergency. A limited snow and ice emergency would be declared in those circumstances where vehicles do not have to be removed from the snow emergency routes named in § 560-34 but where all motor vehicles traveling on those designated snow routes shall be equipped with snow tires, all weather tires, chains, or tires with studs during the periods of time that are approved by the commonwealth.

§ 560-38 Driving restrictions during a declared limited snow and ice emergency.

After a limited snow and ice emergency is declared, it shall be unlawful at any time during the continuance of the emergency for any person to drive any motor vehicle on any snow emergency route, unless that vehicle is equipped with snow tires, all weather tires, chains or tires with studs during the periods of time that are approved by the commonwealth.

§ 560-39 Violations and penalties.

If at any time during a period of snow emergency declared under § 560-32 a person shall park a motor vehicle or allow a motor vehicle to remain parked anywhere upon a snow emergency route, that person shall be guilty of a violation of this article and, upon conviction, shall be sentenced to pay a fine as specified in Chapter 285, Fees.

If at any time during a period of snow emergency declared under § 560-32 a person drives a motor vehicle upon a snow emergency route without having that vehicle equipped with snow tires, all weather tires, chains, or tires with studs during the periods of time that are approved by the commonwealth, that person shall be guilty of a violation of this article and, upon conviction, shall be sentenced to pay a fine of $25 and costs.
