The Division of Purchasing shall be headed by a Director. The method of choosing the Director shall be as provided in §
C3.02, Subsection
(w), of Article
III of the Charter. The qualifications of the Director of Purchasing shall be as follows:
A. At least eight years of experience in the purchase
of supplies and equipment, the preparation of materials and services
specifications or retail sales involving pricing or cost analysis
of items or goods; or
B. Graduation from a regionally accredited or New-York-State-registered
college or university with a bachelor's degree in business administration,
retail sales management, marketing or a closely related field and
four years of experience as noted above; or
C. An equivalent combination of training and experience as defined by the limits of Subsections
A and
B above.
On or before March 1 in each year, the Director
of Purchasing shall make an annual report for the immediately preceding
calendar year, covering generally the work of the Division of Purchasing.
The Director shall make such other reports at such times as may be
required by the County Legislature, County Executive or any other
applicable law. Copies of all reports shall be filed with the Clerk
to the County Legislature and the County Executive.
The County Legislature shall have the power,
by resolution, local law or ordinance, to establish such rules, regulations
and charges not inconsistent with law relating to the Division of
Purchasing, and such rules, regulations or charges so established
shall become valid upon being filed with the Clerk to the Legislature,
the County Executive, the Director of Purchasing, the Department of
Records and the Commissioner of General Services.
The Director of Purchasing, and such of his
or her deputies, officers and employees as the County Legislature
shall require, shall each give a surety bond to the County conditioned
for the faithful performance of his or her duties. Each bond shall
be approved as to form by the County Attorney and as to the sufficiency
of surety by the County Executive and filed with the Department of
Records.
