There shall be a Department of Public Transportation, headed by a Commissioner, which shall provide a balanced and environmentally sensitive network of safe, economic and efficient transportation for the residents of Rockland County. The method of choosing the Commissioner shall be as provided in §
C3.02 of Article
III of the Charter. The Commissioner of Public Transportation shall be appointed on the basis of his or her administrative and managerial experience and other responsibilities of his or her office and such additional qualifications as may be prescribed by the County Legislature.
The Commissioner of Public Transportation shall:
A. Be the chief transportation officer of the County.
B. Plan, monitor and coordinate all aspects of public
transportation in and for the County of Rockland.
C. Have the power to operate and manage a bus transit
system for the County of Rockland, which shall be known as "Transportation
of Rockland (TOR)."
D. Proceed as effectively as possible in the direction
and control of the conduct, maintenance, extension, repair, care and
operation of the Rockland County Transportation System.
E. Have charge, supervision and custodial care of all
vehicles, buildings and any other real or personal property, things
or matters appurtenant thereto relating to the Rockland County Transportation
System.
F. Be responsible for the preparation, submission and
administration of all applications for state and federal grants for
public transportation in the County.
G. Represent the County in dealing with federal, state,
Town, Village and regional transportation agencies.
H. Have charge of and have the duty of performing other
functions concerning the transportation system and other modes of
transportation as the County Legislature may, from time to time, direct.
I. Exercise all the powers and duties heretofore or hereafter
lawfully conferred or imposed upon him by the Charter, this code,
local law, ordinance or resolution of the County Legislature or any
other applicable state law not inconsistent with the Charter or this
code. He or she shall also perform such other related functions as
the County Legislature or the County Executive may designate in order
to implement and accomplish the policies and responsibilities the
County Legislature has prescribed.
On or before March 1 in each year, the Commissioner
of Public Transportation shall make an annual report for the immediately
preceding calendar year, covering generally the work of his or her
Department. The Commissioner shall make such other reports at such
times as may be required by the County Legislature, County Executive,
or other applicable law and the New York State Department of Transportation.
All reports shall be filed with the Clerk to the County Legislature
and the County Executive.
The County Legislature shall have the power,
by resolution, local law or ordinance, to establish such rules, regulations
and charges relating to the Department of Public Transportation as
it may deem necessary. Any such rules, regulations or charges so established
shall become valid upon being filed with the County Executive, the
Commissioner of Public Transportation and the Department of Finance.
