These rules and regulations shall be known as
the Sewer Use Law - 1997. They supersede Local Law No. 3 of 1977,
as amended by Local Law No. 9 of 1977; Local Law No. 5 of 1978; and
Local Law No. 2 of 1984.
The specific purposes of this chapter are the
following:
A. To prevent the introduction of substances into the
POTW that will:
(1) Interfere with the POTW in any way.
(2) Pass through the POTW, to the receiving waters and
cause contravention of standards for those waters or cause violation
of the POTW's SPDES permit, or otherwise be incompatible with the
POTW.
(3) Increase the cost or otherwise hamper the disposal
of POTW sludge and/or residuals.
(4) Endanger the general public or POTW personnel who
may be affected by wastewater and sludge in the course of their employment.
(5) Cause air pollution, or groundwater pollution, directly
or indirectly.
(6) Cause, directly or indirectly, any public nuisance
condition.
B. To prohibit the contribution of sewage and industrial
wastes, and other wastes, which cause maintenance difficulties in
the trunk sewers, force mains, pumping stations, sewage regulators
and other structures and appurtenances to the sewer district's system
and public sewer tributary thereto.
C. To require the treatment, before introduction into
the sewer district's sewer system, local sewer collection systems
and/or other public sewers tributary thereto, of such wastes as may
otherwise impair the strength and/or durability of the structures
appurtenant to the system by direct or indirect chemical action, or
interfere with the normal collection and treatment processes.
D. To prohibit excessive volumes and/or inordinate rates
of flow of sewage and wastes into the sewer district's sewer system,
and/or local sewer collection systems and/or other public sewers tributary
thereto.
E. To prevent new sources of infiltration and inflow
and, as much as possible, eliminate existing sources of infiltration
and inflow.
F. To assure that new sewers and connections are properly
constructed.
G. To provide for equitable distribution to all users
of the POTW of all costs associated with sewage transmission, treatment
and residuals disposal, and to provide for the collection of such
costs.
H. To provide the authority and procedure for the sewer
district to promulgate rules, to investigate and prepare findings
of facts, to issue licenses or permits, to hold hearings, to make
decisions, orders and opinions, and to give notice and make public
all rules and decisions.
I. To provide cooperation with the Rockland County Department
of Health, the New York State Department of Environmental Conservation,
the New York State Department of Health, the United States Environmental
Protection Agency, and other agencies which have requirements of jurisdiction
for the protection of the physical, chemical and bacteriological quality
of watercourses within or bounding the County.
J. To protect the public health and to prevent nuisance.
K. To improve the opportunity to recycle and reclaim
wastewater and sludge from the system.
All local laws and/or regulations of any local
governing body must be adhered to in addition to this chapter. This
chapter will supersede those local laws and/or regulations only where
conditions herein are more stringent.
Except as otherwise provided herein, the Executive
Director shall administer, implement and enforce the provisions of
this chapter. Any powers granted to or duties imposed upon the Executive
Director may be delegated by the Executive Director to other district
personnel.
