[HISTORY: Adopted by the City Council of the City of Papillion 12-4-1990 as Secs. 302 and 303 of the 1990 Code; amended in is entirety 3-16-2004 by Ord. No. 1435. Subsequent amendments noted where applicable.]
As used in this chapter, unless the context otherwise requires, the following terms shall have the meanings indicated:
AIR GUN
Any instrument which releases a projectile by means of compressed air or gas.
FIREARM
Any instrument which releases a projectile by means of an explosive charge.
PAINTBALL
Any gun which releases a paintball propelled by a spring mechanism or compressed gas.
SLINGSHOT
Any metal, wood, or plastic instrument which releases a rock or other projectile by means of elastic band or other material stretched by human effort.
It shall be unlawful for any person, except an officer of the law in the discharge of his/her official duty, to fire or discharge any firearm within the municipality; provided that nothing herein shall be construed to apply to officially sanctioned public celebrations if the persons so discharging firearms have written permission from the Council.
It shall be unlawful for any person to discharge a slingshot, air gun or the like loaded with rock or other dangerous projectiles at any time or under any circumstances within the municipality.
It shall be unlawful for any person to discharge a paintball gun within the municipality, and/or knowingly or purposely transport in any conveyance or in any other manner, or to possess outside of his/her own premises, any paintball gun unless it is unloaded and contained in an enclosed case, or unloaded and unassembled.
Any person who violates any of the prohibitions or provisions of any section of this chapter shall be deemed guilty of a misdemeanor. Unless otherwise specified in the particular section for which the person stands convicted of violating, the penalty for such violation shall be fined in any sum not exceeding $500 or imprisoned six months, or both said fine and imprisonment at the discretion of the sentencing court.
