Enlargement of an existing principal building to be
used for multifamily, commercial or industrial purposes or of any
public use or building, when such enlargement exceeds 10% of the floor
area of the existing building or 1,000 square feet, whichever is less.
Construction of any parking area for five or more
vehicles or any addition to or alteration of the arrangement or means
of access to any existing parking area for five or more vehicles which
is accessible by way of a driveway connecting to a public street.
Any use or building for which a conditional use permit is required by this chapter shall not require site plan review as described in this Article, but shall be subject to the review and approval process described in Article XVI of this chapter.
The purpose of site plan review is to ensure
compliance with regulations and development standards contained in
this chapter and to ensure that the purpose and intent of this chapter
are met.
For all proposed development a site plan for the use
and development of the entire tract shall be submitted to the Zoning
Administrator. The site plan shall conform to the following requirements:
Provide a form for certification by the owner and
trustee of the mortgage, if any, that they adopt the plan, and dedicate
the streets as shown on the plan and agree to make any required improvements
of adjacent streets as shown on the plan.
Additional submission requirements. The Zoning Administrator,
Planning Commission or Town Council may require such additional plans
and information as needed to determine compliance with development
standards and requirements of this chapter or to assess the general
compatibility of the proposed development with surrounding uses and
buildings. In the case of new buildings and additions to existing
buildings, elevation drawings may be required.
Waiver of site plan specifications. With prior approval
by the Zoning Administrator, particular information may be omitted
from required site plans when, due to the nature or limited scope
of a project, such information is not necessary for evaluation of
the site plan or for purposes of maintaining a record of site plan
approval.
Submission to Zoning Administrator. Three copies of
required plans and information shall be submitted to the Zoning Administrator,
who shall review such plans and information and forward them to the
Planning Commission within 30 days.
Planning Commission review and recommendation. The
Planning Commission shall review the site plan and related information
and submit a recommendation to the Town Council within 30 days after
the first meeting of the Commission at which the site plan is presented.
The Commission may recommend to the Council that the site plan be
approved as submitted, be approved with specific modifications or
be disapproved.
Action by Town Council. The Town Council shall review
the site plan and take action to approve, to approve with specific
modifications or to disapprove the site plan within 30 days after
the first meeting of the Council at which the site plan is presented.
In the case of approval with modifications or disapproval of a site
plan, the Council shall state the specific modifications or its reasons
for disapproval.
Issuance of zoning permits. Following approval of
a site plan by the Town Council, the Zoning Administrator shall be
authorized to issue necessary zoning permits consistent with such
approval.
Commercial districts. Waste disposal facilities, exterior
storage and other accessory uses which by their nature must exist
outside a building shall be appropriately screened and maintained.
All uses shall be conducted within completely enclosed
buildings except for parking and loading, exterior storage and other
accessory uses which by their nature must exist outside a building.
Exterior storage may be permitted in the side and
rear of the principal building only, provided that the location, extent
and screening of storage is approved as a part of the site plan by
the Planning Commission, and further provided that exterior storage
shall be screened from public view by a suitable fence, wall or hedge
not exceeding 15 feet in height with the stored materials to be kept
at least two feet below the top of such screen.
All storage areas shall be surfaced with concrete,
asphalt, tar and gravel or gravel that provides a dust-free surface.
All areas shall be graded and drained so as to dispose of all surface
water in compliance with applicable stormwater management regulations.
