A. Definitions. As used in this section, the following terms shall have
the meanings indicated:
AMUSEMENT DEVICE
Any coin-operated machine or device, the operation of which
involves a skill feature and which is operated by coins of any denomination.
MECHANICAL MUSICAL DEVICE
Any mechanical phonograph, nickelodeon or other musical device
operated by the use of coins or similar tokens.
B. License required. Every person being an owner of amusement devices
or mechanical musical devices, as herein defined, shall make application
to the City Clerk for a license. The license fee for the owner's
license shall be $25 per year and shall be paid to the Clerk at the
time of filing the application for such license. A person keeping
such device only on premises in his possession shall not be required
to pay the initial fee but shall pay the registration fee for each
machine. Such license shall be granted only to persons qualified to
do business within the state. The license shall run from July 1 to
June 30 in each succeeding year. The Clerk shall provide appropriate
forms of licenses and keep and maintain adequate records of the issue
thereof hereunder. No license shall be issued if the applicant is
delinquent in payment of any taxes, assessments, forfeitures for violations
of City ordinances, utility bills, or any other claims owed to the
City.
C. Registration of devices.
(1) Every person owning any amusement device or mechanical musical device
and having obtained a license under this section permitting the ownership
of such device, in addition to the license requirements, shall register
such device with the Clerk. The registration fee shall be $10 per
device or machine. Such registration fee shall be paid to the Clerk
at the time of registration. The Clerk shall require the registrant
to submit such information as may be necessary to identify the device
registered. If he is satisfied that the device is entitled to be registered,
he shall issue to the registrant an appropriate certificate of registration
and a registration symbol so designed as to permit secure attachment
to the device and to remain thereon for the license period, except
as otherwise provided.
(2) Such registration shall remain in effect until June 30 following
the date of registration, at which time every such device shall be
reregistered. The registration fee for each year or part thereof shall
be $10.
(3) No person shall be entitled to register any amusement device or mechanical
musical device under the provisions of this section unless he is of
good moral character and a citizen of the United States.
(4) The Clerk may authorize the transfer of a registration symbol from
one such device to another when satisfactory evidence is presented
showing that the use of the device previously registered has been
discontinued and that the new device to which the symbol is proposed
to be attached is an amusement device or mechanical musical device.
(5) The Clerk shall keep an appropriate record of the registration of
each amusement device and mechanical musical device, showing the name
and number and such other information as he shall deem necessary concerning
each device registered, and shall also keep a similar record of the
devices for and to which transfers of symbols have been authorized
hereunder.
D. Counterfeiting symbol; unauthorized transfer; false statements. No
person shall counterfeit or falsify a registration symbol or shall
transfer a registration symbol from one amusement device or mechanical
musical device to another without having previously registered such
transfer with the Clerk, and no person shall make any false statements
in any application for registration under this section or in any registration
statement required hereunder.
Any person owning and offering for use by the public a pool
or billiard table which is not coin operated shall pay a license fee
for each such table of $10 per year.
The owner of any bowling alley or alleys offering such for use
by the public shall pay a license fee for each such alley of $5 per
year.
Except as otherwise provided, any person who shall violate any provision of this chapter shall be subject to a penalty as provided in Chapter
1, §
1-18, of this Municipal Code.
