Except as otherwise specifically provided in
this chapter, the statutory provisions in Chs. 340 to 350, Wis. Stats.,
describing and defining regulations with respect to vehicles and traffic,
exclusive of any regulations for which the statutory penalty is a
fine or term of imprisonment, are adopted and by reference made a
part of this chapter as if fully set forth herein. Any act required
to be performed or prohibited by any statute incorporated herein by
reference is required or prohibited by this chapter. Any future amendments,
revisions, or modifications of the statutes incorporated herein are
intended to be made part of this chapter in order to secure uniform
statewide regulation of traffic on highways, streets, and alleys of
the state.
Through streets, stop signs, yield right-of-way
signs, one-way streets, prohibited U-turns and parking restrictions
shall be shown on an official traffic map on file in the office of
the Police Department, which map is adopted as part of this section.
Failure to observe the restrictions shown on such map shall be a violation
of this chapter. The Council may, from time to time, make additions
to or deletions from such traffic map. The Chief of Police shall cause
all such additions to or deletions from such map to be made.
A. Left turn only lanes are designated as follows:
(1) The easterly southbound lane on South Main Street
from a point 264 feet north of its intersection with Dane Street,
south to said intersection.
B. Right turn
only lanes are designated as follows:

westerly southbound lane on North Main Street from a point 100 feet
north of its intersection with West Racine Street, south to said intersection.
(2) The
northbound lane of South Jackson Avenue from a point 250 feet south

A. No left
turns shall be made as follows:
(1) Westerly
bound traffic (except school buses) on West Milwaukee Street, 585
feet (easterly ingress/egress of West Elementary) and 945 feet (westerly
ingress/egress of West Elementary) from the intersection with South
Taft Avenue
A. Winter parking. On all streets in the City from December 1 through
March 31, parking shall be permitted from 6:00 p.m. daily and shall
be in effect until 5:59 p.m. the following day (24 hours).

(1) On even calendared days vehicles shall park on the even side of the
street which has even house numbers until 6:00 p.m.
(2) On odd calendared days vehicles shall park on the odd side of the
street which has odd house numbers until 6:00 p.m.
(3) After 6:00 p.m. daily, vehicles shall be required to move to the
alternate side of the street based on the following day's date.
(4) Excepting
on those streets and areas where parking is prohibited between 2:00
a.m. and 6:00 a.m. or within a limited parking zone (which shall include
designated thirty-minute, one-hour and two-hour parking areas) between
the hours of 9:00 a.m. and 5:00 p.m. vehicles shall obey posted erected
parking regulation signs.
(5) If
any vehicle shall be parked in violation of this subsection, the Police
Department shall ticket the vehicle and may order it towed from the
street at the owner's risk after the vehicle has been ticketed. The
fine for violating this subsection shall be as prescribed by the Municipal
Court Bond in effect, plus the towing charge for each occurrence.

C. Perpendicular parking. Parking motor vehicles, except
motorcycles, in diagonal or perpendicular parking stalls shall be
such that the front of the vehicle shall be closest to the curb or
parking aid and the rear of the vehicle closest to the traveled portion
of the street or parking lot.
D. No parking.
(1) No person shall park any motor vehicle on any street
in the City for a period of more than 48 consecutive hours.
(2) No person shall park any motor vehicle in an off-street
parking lot owned or controlled by the City for a period of more than
48 consecutive hours.
(3) No person shall park any trailer not hitched to a
motor vehicle on any City street or parking lot without having obtained
a permit from the Police Department, The fee for such permit shall
be as set by the Common Council, and the permit shall be limited to
seven days but may be renewed. For the purpose of this subsection,
"trailer" shall include any obstruction of the City street or parking
lot, other than a motor vehicle, except debris from natural causes.
The prohibition against parking of trailers does not apply to South
Ryan Avenue and South Industrial Avenue during the period of September
15 through October 31. During this period trailers shall not be parked
within 25 feet of any intersection or within 20 feet of an existing
driveway on the east side of South Ryan Avenue. No trailer shall be
parked on either of said streets for more than 48 consecutive hours.
Trailers so parked in the street shall have a three-foot plank placed
under the dolly wheels and the wheels shall be chucked.
(4) No person shall park any motor vehicle or trailer
on any tree lawn within the street right-of-way, except upon an established
driveway.
(5) The following shall be posted as "No Parking on School
Days, 7:30 a.m. to 4:30 p.m.":

(10) No person shall park a motor vehicle with a combination
vehicle load weight exceeding 8,000 pounds gross in any block on any
street where single-family or multifamily housing is present on the

(14) No parking from April 1 to December 1. No person shall
park any motor vehicle between the dates of April 1 and December 1

E. Handicap parking. Parking of vehicles in spaces so
designated shall be restricted to those vehicles displaying special
identification cards or license plates as provided for in §§ 343.51
and 346.505, Wis. Stats. Handicapped parking spaces shall be designated
at the following locations:

F. Restricted parking for compact cars only.
(1) The term "compact cars" shall be defined by using
www.fueleconomy.gov, a site maintained by the United States Department
of Energy and United States Environmental Protection Agency.

H. Parking restriction forfeitures. All violations of
this section providing for a forfeiture shall double if the original
forfeiture is not paid within 15 days after the date of violation,

(1) No person/vehicle shall park at locations clearly marked (signed)
for cab parking only. The following locations shall be designated
licensed cab parking only:

The northernmost stall on the eastern side of South Main Street
abutting Milwaukee Street directly adjacent to 206 South Main Street.
(2) Any person violating said licensed cab parking ordinance restriction
shall be subject to the parking forfeitures specified in the Municipal
Code for violation of two-hour parking restrictions.
J. No unregistered
vehicle may be parked on any City street or public parking lot at
any time.

K. Temporary
no parking/limited term parking/police - authority/parades or special
events. The City of Jefferson Police Department Chief of Police or

No person shall operate or park any motor vehicle
on any street in the City for the primary purpose of advertising.
A. The Police Department may remove or cause to be removed any motor vehicle parked in violation of §
265-4 or
265-6 of this chapter.
B. In addition to any other assessments or costs imposed by this chapter, the owner of any vehicle removed or caused to be removed by the Police Department pursuant to Subsection
A shall be required to pay the costs of towing and storage. The charge for storage at the City garage area shall be as set by the Common Council.
A. State snowmobile laws adopted. Except as otherwise specifically provided
in this chapter, the statutory provisions describing and defining
regulations with respect to snowmobiles in the following enumerated
sections of the Wisconsin Statutes (as may from time to time be amended)
are hereby adopted by reference and made a part of this section as
if fully set forth herein. Acts required to be performed or prohibited
by such statutes are required or prohibited in this section.

B. Applicability of rules of the road to snowmobiles. The operator of
a snowmobile upon a roadway shall, in addition to the provisions of
Ch. 350, Wis. Stats., be subject to Chapter 346, Wisconsin Statutes,
"Rules of the Road" as may from time to time be amended.

C. Permitting operation by improper persons prohibited.
No owner having charge or control of a snowmobile shall authorize
or permit any person to operate the snowmobile who is not permitted
under state law to operate a snowmobile or who is under the influence
of an intoxicant or a dangerous or narcotic drug.
D. Operation while under influence prohibited. Section
346.63, Wis. Stats., shall apply to the operation of a snowmobile
any place within the City.
E. Written consent of owner required. The consent required
under § 350.10(1)(f), (k), (L) and (m), Wis. Stats., shall
be written consent dated and limited to the year in which the consent
is given. If the property is owned or leased by more than one person,
the consent of each must be obtained.
F. Except as provided in § 350.03, Wis. Stats., no person
shall operate a snowmobile upon any public right-of-way, sidewalk,
cemetery property, or any public property, except upon designated
snowmobile trails.

G. Snowmobile routes and trails are subject to change as deemed necessary
and upon approval by the Common Council of the City of Jefferson.
Organized snowmobile clubs shall be responsible for the marking and
maintaining of designated routes and trails which may have been approved
by the Common Council and within the City, in accordance with Wisconsin
Statutes.

K. Penalties. Any person who shall operate a snowmobile in violation
of this section, in addition to the penalties in Chapter 346, Wis.
Stats., Rules of the Road, shall forfeit to the City not less than
$50, nor more than $200, for each violation together with costs and
assessments imposed under Chapter 814, Wis. Stats. This penalty section
may be amended and set annually by the Common Council.

The Police Department shall procure, erect,
and maintain official signs and signals giving notice of speed limits,
required stops, heavy traffic routes, one-way streets and alleys,
prohibited U-turns and parking restrictions.
A. No railroad train, locomotive or car shall be stopped
and left standing upon any highway or street crossing in the City
longer than five minutes, except in cases of accident.
B. Any conductor, engineer, brakeman or other person in charge of such train, locomotive, or car, or any person who shall be responsible therefor, who shall violate this section shall be subject to a penalty as provided in Chapter
1, Article
I of this Code.
No person shall operate any motorized vehicle in any City park except upon areas designated as a roadway or for parking. This section shall not apply to person performing maintenance within the City's parks. Any person who shall violate this section shall be subject to a penalty as provided in Chapter
1, Article
I of this Code.
No person operating a motor vehicle shall pass
on the right on South Main Street beginning in the southbound lane
from the southwest corner of the intersection of South Main Street
and West Dodge Street to the northwest corner of the intersection
of South Main Street and West Rockwell Street, or in the northbound
lane starting at the southeast corner of the intersection of South
Main Street and Clara Street to the southeast corner of the intersection
of South Main Street and East Dodge Street, except where authorized
by state law at intersections.
A. This section shall apply to all premises held out
to the public for use, whether such premises are publicly or privately
owned and whether or not a fee is charged for the use thereof. This
section shall not apply to any street or highway.
B. No person shall operate a motor vehicle on such premises:
(1) Across parking stalls indicated by painted lines.
(2) In a manner commonly referred to as "spinning doughnuts,"
wherein the vehicle is driven rapidly in a tight circle.
(3) The wrong way in a driving lane where such wrong way
is indicated by painted arrow or by the entry angle of adjoining parking
stalls, or left of a marked center line in a driving lane.
(4) Without stopping for a stop sign posted on such premises.
The stop required hereunder is defined in § 346.46(2), Wis.
Stats.
(5) At a speed in excess of posted limits.
(6) At a speed greater than is reasonable and prudent
under the conditions and having regard for the actual and potential
hazards then existing. The speed of a vehicle shall be so controlled
as may be necessary to avoid colliding with any object, person, vehicle
or other conveyance on such premises and in compliance with legal
requirements and using due care.
C. No person shall park, stop, or leave any vehicle standing,
whether attended or unattended and whether temporarily or otherwise,
upon any of the following designated areas of such premises:
(1) Upon any portion of such premises where stopping or
standing is prohibited by appropriate signs indicating the prohibition
of any stopping or standing.
(2) Except for a motor vehicle used by a physically disabled
person as defined under § 346.503(1), Wis. Stats., upon
any portion of such premises reserved by official traffic signs indicating
the restriction to vehicles used by physically disabled persons.
A. Registration required. No person shall operate a bicycle
upon any street within the City unless such bicycle has been properly
registered and tagged as provided in this section. A bicycle is a
vehicle, as such, subject to regulation in its operation as other
types of vehicles where applicable.
B. Filing description of bicycle. Every owner or operator
of any bicycle within the City shall file with the Chief of Police
a complete description of such bicycle upon a blank form to be provided
by the City for such purpose. The filing of such description shall
constitute a registration of such bicycle. The list of registrations
shall be kept serially in the office of the Chief of Police as a public
record.
C. Identification tag. Immediately upon the registration
of a bicycle in his office, the Chief of Police shall affix to such
bicycle an identification tag serially numbered to correspond with
the registration of such bicycle. Such tag shall thereafter remain
affixed to such bicycle, unless removed for cause by the Police Department.
D. Inspection of bicycles. The Chief of Police shall
inspect each bicycle presented to him for registration and he shall
refuse to register any bicycle found by him to be in an unsafe condition
or without proper equipment for safe operation, including an adequate
warning device.
E. Riding on sidewalks prohibited in commercial and industrial
districts. No person shall ride a bicycle, skateboard or scooter on
sidewalks located within any commercial or industrial districts of
the City.
F. Cancellation and removal of registration. The Chief
of Police may cancel the registration of and remove the identification
tag from any bicycle being operated upon any street in the City in
an unsafe manner or in violation of any state law or local ordinance.
Such cancellation and removal shall be in addition to other penalties
provided hereunder.
G. Transfer of title. Upon transfer of title to any bicycle
registered hereunder, the transferor shall notify the Police Department
of such transfer within 10 days, providing the name and address of
the transferee. The notice shall likewise be given where the bicycle
is dismantled and taken out of operation.
H. Fees. The fees for registration and tagging, and for
issuance of a duplicate registration or tag in the event the original
or replacement thereof is lost, shall be set by the Common Council.
I. Adoption of statutes. Sections 346.77 through 346.804
and 347.489, Wis. Stats., are adopted by reference.
J. Bicycle safety officers. Bicycle safety officers appointed
by the Chief of Police are authorized to enforce bicycle safety regulations
of this Code and the Wisconsin Statutes, and such officers may:
(1) Issue citations for violations of such bicycle regulations.
(2) Advise the parents of minors who violate the safety
regulations.
(3) Require attendance at the bicycle safety course conducted by the bicycle safety officers in lieu of the forfeiture prescribed under § 346.82, Wis. Stats., or the cancellation of registration prescribed under Subsection
F of this section.
K. Headlights on bicycles required. No person shall ride
a bicycle on any right-of-way in the City during the hours of darkness
without a headlight. For purposes of this regulation, "hours of darkness"
shall include the period of time from 1/2 hour after sunset to 1/2
hour before sunrise and all other times when there is not sufficient
natural light to render clearly visible any person or vehicle upon
a street at a distance of 500 feet.
L. Penalty. Any person who shall violate any provision of this section shall be subject to a penalty as provided in Chapter
1, Article
I of this Code.
A. "In-line skates" means skates with wheels arranged
singly in a tandem line rather than in pairs.
B. A person riding upon in-line skates shall ride as
near as practicable to the right edge of the unobstructed traveled
roadway upon any roadway carrying two-way traffic. On one-way roadways,
a person riding on in-line skates shall ride as near as practicable
to the right edge or left edge of the unobstructed traveled roadway.
Every person riding on in-line skates upon a roadway shall exercise
due care when passing a standing vehicle or one proceeding in the
same direction, allowing a minimum of three feet between the person
riding on in-line skates and the vehicle.
C. Persons riding on in-line skates on a roadway shall
ride single file on all roadways.
D. No person may ride on in-line skates upon a roadway
where a sign is erected indicating that in-line skate riding is prohibited.
E. Every person riding on in-line skates shall, upon
entering on a highway, yield the right-of-way to motor vehicles.
F. A person riding on in-line skates on a roadway shall
not impede motor vehicle traffic to said person's rear. If inadequate
space exists for operation of motor vehicles and the person riding
on in-line skates to proceed in the same direction upon any roadway
in the City, then the person riding upon in-line skates shall, upon
the approach of a motor vehicle from the rear, move as far to the
side of the road as possible and stop, if necessary, so as to permit
adequate room for the motor vehicle traffic to pass said person riding
on in-line skates without leaving the lane in which said motor vehicle
traffic is traveling.
G. No person shall ride upon in-line skates on the traveled
portion of the roadway or on the sidewalks in the downtown business
district, which shall be defined for the purposes of this section
as the north two block of South Main Street, the west two blocks of
East Racine Street, and the south one block of North Main Street.
H. No parent or guardian of any child shall authorize
or knowingly permit such child to violate any of the provisions of
this section.
I. No person shall ride upon in-line skates on the traveled
portion of any street or road between the hours commencing 1/2 hour
past sunset and terminating 1/2 hour before sunrise unless said person
carries a light visible from a distance of at least 300 feet to the
front of said person and a red reflector visible from at least 300
feet to rear of said person.
J. Any person violating this section shall forfeit not
less than $10 nor more than $20 for the first offense and not less
than $25 nor more than $50 for the second or subsequent conviction
within a year.
A. Definition. "Dynamic braking device" (commonly referred
to as "jake brakes," "jacobs brake," "engine brake" or "compression
brake") means a device primarily on trucks for the conversion of the
engine from an internal combustion engine to an air compressor for
the purpose of braking without the use of wheel brakes.
B. Use prohibited. It is unlawful for any person to operate
any motor vehicle with a dynamic braking device engaged, except for
the aversion of imminent danger, within the City limits.

A. Costs of towing. If it becomes necessary for a motor
vehicle to be towed for any reason pursuant to an order of the City
of Jefferson Police Department, the owner or operator of said motor
vehicle, in addition to the actual costs of towing said motor vehicle
charged by the company doing the towing, shall be responsible to pay
an administrative removal charge for expenses incurred by the City
of Jefferson. The amount of the administrative charge shall be determined
from time to time by resolution of the City Council.
B. Payment. Due to storage concerns, payment of the administrative
removal charge shall not be a condition precedent to the release of
a vehicle to the owner. The City of Jefferson will use all means of
collection available, including, but not limited to, tax intercept,
to collect the administrative removal charge from the owner or operator.

A. Use of neighborhood electric vehicles shall be permitted on all City
of Jefferson streets and county trunk highways posted at or below
the speed limit of 35 miles per hour. Pursuant to § 349.26,
Wis. Stats., operation shall be permitted on all roadways.
B. Requirements of operation of neighborhood electric vehicles will
be pursuant to Wisconsin State Statutes and consistent with all other
vehicle operation per state and local regulation. Neighborhood electric
vehicles shall:
(1)
Be operated by a valid driver in this state or other state (properly
licensed by the department of transportation).
(2)
Be properly registered as required by Wisconsin State Statute.
(3)
Shall be operated in full compliance of all State of Wisconsin
traffic laws and motor vehicle equipment laws, specifically inclusive
of riding within said vehicle and in designated seating positions.
(4)
Shall not be operated off of any roadway (off-road) including,
but not limited to, City of Jefferson sidewalks, multiuse trails or
parks.
(5)
Shall not be operated on the private property of another person
without permission from said property owner.
(6)
Shall be subject to all parking regulations.
(7)
Shall be subject to all traffic laws.
Except as otherwise provided, the penalty for
violation of any provision of this chapter shall be a forfeiture as
provided in this section together with costs under § 345.27,
Wis. Stats., and a penalty assessment under § 757.05, Wis.
Stats.
A. State forfeiture statutes. Any forfeiture for violation of the state statutes adopted by reference in §
265-1 shall conform to the forfeiture permitted to be imposed for violation of such statutes as set forth in the Uniform Deposit and Misdemeanor Bail Schedule of the Wisconsin Judicial Conference, including any variations or increases for subsequent offenses, which schedule is adopted by reference.
B. State fine statute. The forfeiture for violation of
any statute adopted by reference hereunder for which the penalty is
a fine shall not exceed the maximum fine permitted under such statute.
C. Local regulations. Unless otherwise provided, the penalty for violation of any provisions of this chapter not included under Subsection
A or
B above shall be as provided in Chapter
1, Article
I of this Code.
A. Enforcement procedure. This chapter shall be enforced
according to §§ 23.33, 66.0114, 345.11, 350.17, and
Ch. 799, Wis. Stats.
B. Deposit.
(1) Any person arrested for a violation of this chapter
may make a deposit of money as directed by the arresting officer at
the police station or at the office of the Clerk of Courts or by mailing
the deposit to such places. The arresting officer or the person receiving
the deposit shall notify the arrested person, orally or in writing,
that:
(a)
If the person makes a deposit for a violation
of a traffic regulation, the person need not appear in court at the
time fixed in the citation and the person will be deemed to have tendered
a plea of no contest and submitted to forfeiture and penalty assessment
if required by § 757.05, Wis. Stats., a jail assessment
if required by § 302.46(1), Wis. Stats., plus any applicable
fees prescribed in Ch. 814, Wis. Stats., not to exceed the amount
of the deposit that the court may accept as provided in § 345.37,
Wis. Stats.
(b)
If the person fails to make a deposit for a
violation of a traffic regulation or appear in court at the time fixed
in the citation, the court may enter a default judgment finding that
person guilty of the offense or issue a warrant for his arrest.
(2) The amount of the deposit shall be determined in accordance
with the deposit schedule established by the Wisconsin Judicial Conference
and shall include the penalty assessment under § 757.05,
Wis. Stats., and jail assessment if required by § 302.46(1),
Wis. Stats., plus costs.
(3) The arresting officer or the person receiving the
deposit shall issue the arrested person a receipt therefor as required
by § 345.26(3)(b), Wis. Stats.
(4) If a deposit schedule has not been established, the
arresting officer shall require the alleged offender to deposit not
less than the maximum forfeiture permitted under this chapter, which
shall include the penalty assessment established under § 757.05,
Wis. Stats. Deposits for non-moving violations shall not include the
penalty assessment.
C. Petition to reopen judgment. Whenever a person has
been convicted in this state on the basis of a forfeiture of deposit
or a plea of guilty or no contest and the person was not informed
as required under § 345.27(1) and (2), Wis. Stats., the
person may, within 60 days after being notified of the revocation
or suspension of the operating privilege, petition the court to reopen
the judgment and grant him an opportunity to defend on merits. If
the court finds that the petitioner was not informed as required under § 345.27(1)
and (2), Wis. Stats., the court shall order the judgment reopened.
The court order reopening the judgment automatically reinstates the
revoked or suspended operating privilege.

A. The provisions of § 23.33, Wis. Stats., and the defining
regulations found in Ch. NR 64, Wis. Adm. Code, with respect to the
regulation of all-terrain vehicles, including any future amendments
thereof, are hereby adopted by reference and made part of this section
as if fully set forth herein. Acts required to be performed or prohibited
by such statutes are required or prohibited in this section.
B. The operator of an ATV/UTV shall be subject to §§ 346.02(11),
346.04, 346.06, 346.11, 346.14(1), 346.18, 346.19, 346.21, 346.215(3),
346.22, 346.27, 346.33, 346.35, 346.37, 346.39, 346.44, 346.46, 346.47,
346.48, 346.50, 346.50(1)(b), 346.51, 346.52, 346.53, 346.54, 346.55,
346.71, 346.87, 346.88, 346.89, 346.90, 346.91, 346.92(1), and 346.94(1)
and (9), Wis. Stats. Acts required to be performed or prohibited by
such statutes are required or prohibited by this article.
As used in this article, the following terms shall have the
meanings indicated:
ALL-TERRAIN VEHICLE (ATV)
A commercially designed and manufactured motor-driven device
that does not meet federal motor vehicle safety standards effective
July 1, 2012, that is not a golf cart, low-speed vehicle, dune buggy,
mini-truck, or tracked vehicle, that is designed to be used primarily
off of a highway, and that has, and was manufactured with, all of
the following:
A.
A weight, without fluids, of 900 pounds or less.
C.
A steering handlebar, single or dual headlights, a taillight
and brake light.
D.
A width of no more than 50 inches.
ATV/UTV ROUTE
A street designated for use by ATV/UTV vehicle operators
by the governmental agency having jurisdiction as authorized by this
article.
OPERATE
To exercise physical control over the speed or direction
of an all-terrain vehicle or physically manipulate or activate any
of the controls of an all-terrain vehicle necessary to put it into
motion.
STATE TRUNK HIGHWAY
Any highway designated pursuant to § 84.29, Wis.
Stats., as part of the state trunk highway system, exclusive of connecting
highways.
STREETS
Every highway within the corporate limits of the City except
alleys.
UTILITY-TERRAIN VEHICLE (UTV)
A commercially designed and manufactured motor-driven device
that does not meet federal motor vehicle safety standards effective
July 1, 2012, that is not a golf cart, low-speed vehicle, dune buggy,
mini-truck, or tracked vehicle, that is designed to be used primarily
off of a highway, and that has, and was manufactured with, all of
the following:
A.
A weight, without fluids, of 3,000 pounds or less.
C.
A cargo box installed by the manufacturer measured laterally
between the outermost wheel run on each side of the vehicle, exclusive
of tires, mirrors, and accessories that are not essential to the vehicle's
basic operation.
D.
A steering wheel, taillights and brake lights, and two headlights.
E.
A width of no more than 65 inches.
F.
A system of seat belts, or similar system, for restraining each
occupant of the device in the event of a collision.
G.
A system of structural members designed to reduce the likelihood
that an occupant would be crushed as a result of a rollover of the
device (roll bars).
A. ATV/UTV usage shall be authorized on all City streets except as follows:

(1) No usage on Business State Highway 26 North on Main Street from Puerner
Street to North Watertown Avenue/Junction Road.
B. ATV/UTV vehicles shall not be operated on any sidewalk within the
City of Jefferson.
C. The Jefferson Police Department may temporarily close any ATV/UTV
route whenever conditions require closure.
All ATV/UTV operators shall be 16 years or older to operate
an all-terrain vehicle on road routes in the City holding a valid
Wisconsin driver's license. All sixteen-year-old licensed riders who
have not attained the age of 18 shall be required to wear a helmet
and eye protection. The operator, upon request from any law enforcement
officer, state patrol, or inspector under § 110.07(1), Wis.
Stats., conservation warden, or municipal peace officer, shall display
said operator's license to said agent as well as proof of insurance
and registration.

All ATV/UTV operators shall observe the posted speed limits
on City streets.
All ATV/UTV vehicles operated within the City of Jefferson on
designated routes are required to have State of Wisconsin registration
as issued by the Wisconsin Department of Natural Resources.
A. All ATV/UTV operators shall ride single file on the right side of
the pavement but shall not operate on the shoulders or in the ditch.
B. Headlights and taillights shall be on at all times.
C. All-terrain/utility-terrain vehicles shall yield the right-of-way
to nonmotorized vehicles, such as bicycles and pedestrians.
D. No person shall leave or allow an all-terrain/utility-terrain vehicle
owned or operated by him/her to remain unattended on any public highway
or public property while the motor is running or with the starting
key left in the ignition.
E. No owner having charge or control of an all-terrain/utility-terrain
vehicle shall authorize or permit any person to operate such all-terrain
vehicle who is not permitted under state law to operate an all-terrain/utility-terrain
vehicle or who is under the influence of an intoxicant or a dangerous
or narcotic drug.
F. Section 346.63, Wis. Stats., which prohibits the operation of a motor
vehicle while under the influence of an intoxicant or other drugs,
shall apply to the operation of an all-terrain/utility-terrain vehicle
at any place within the City.
G. No person shall operate an all-terrain/utility-terrain vehicle in
the City between the hours of 10:00 p.m. and 5:00 a.m.

H. No operator or passenger of an all-terrain/utility-terrain vehicle
may possess in or on an all-terrain/utility-terrain vehicle on any
street or highway in the City of Jefferson any bottle or receptacle
containing alcohol beverages if the bottle or receptable has been
opened, the seal has been broken, or the contents of the bottle or
receptacle have been partially removed or released.
I. During special events within the City limits, the Chief of Police
is granted authority to allow for all-terrain/utility-terrain vehicle
operation on City streets for the duration of going to or coming from
said event or during a parade. An operator needs to contact the Jefferson
Police Department and provide their name, all-terrain/utility-terrain
device type and registration number, and the Chief of Police will
review the request for permission and notify the individual either
verbally or in writing of his/her decision.
J. Groups
of 25 or more ATV/UTV operators shall notify the Jefferson Police
Department before entering the legal boundaries of the City.

A. Organized all-terrain vehicle clubs shall be responsible for marking
all all-terrain vehicle routes with uniform all-terrain route signs
in accordance with §§ NR 64.12 and 64.12(7)c, Wis.
Adm. Code, which locations and placement must be approved by the Police
Chief and Public Works Director.
B. All-terrain/utility-terrain vehicle clubs shall be responsible for
creating and circulating a map or maps illustrating the City's current
all-terrain vehicle routes.
Any person who shall operate an all-terrain vehicle in violation
of this article, in addition to the penalties of Ch. 346, Wis. Stats.,
shall forfeit to the City not less than $50, nor more than $200, for
each violation, together with costs and assessments imposed under
Ch. 814, Wis. Stats. This penalty section may be amended and set annually
by the Common Council.
Upon its adoption, the Clerk is hereby directed to send a copy
of this article to the Wisconsin Department of Transportation, the
Wisconsin State Patrol, the Jefferson County Sheriff Department, the
Wisconsin Department of Natural Resources, and the Jefferson Police
Department, pursuant to § 23.33(11)b, Wis. Stats.

A. Definitions. As used in this section, the following terms shall have
the meanings indicated:
GOLF CART
A vehicle designed and manufactured with limited speed capabilities
that does not exceed 20 miles per hour on a paved, level surface that
is designed and intended to convey one or more persons. Modifications
to allow extra seating in the area originally designed to carry equipment
are allowed.
PUBLIC ROADS
Any City road, street, or highway located within the City
boundaries designed to accommodate motor vehicles. State and county
public roads, streets and highways are excluded.
B. Operation and use. Golf carts may be operated upon City public roads
as follows:
(1) All City of Jefferson public roads (except Main Street and Racine
Street) with a speed limit of 25 miles per hour or less. Golf carts
may cross Main Street and Racine Street at intersections.
C. Registration.
(1) No golf cart may be operated on any public street within the City
unless the golf cart has first been registered with the City Clerk
as required herein. The registration shall be valid for three years
and renewed thereafter in accordance with the provisions of this section.
To evidence the registration, the owner shall be issued a permit which
shall be displayed in a prominent, visible place on the rear fender
of the golf cart. The permit may contain a registration number assigned
for the particular golf cart and may contain an expiration date.
(2) An application for registration shall be made to the City Clerk,
or his or her designee, on forms provided by the City. The application
may, among other things, require the owner's name, street address,
mailing address, a phone number, the make, model, and identification
or serial number of the golf cart, proof of insurance and any such
other information as may be reasonably required. The City shall assess
a fee (as determined by the Common Council) to compensate the City
for processing the application. The registration shall be renewed
on a periodic basis as determined by the City.
D. Restrictions.
(1) No persons shall operate a golf cart on the designated public roads
within the City of Jefferson without a valid driver's license
issued in his or her state.
(2) All golf carts operating under this section must be equipped with
adequate functioning brakes, reliable and accurate steering apparatus,
safe and proper tires, rearview mirror, red reflectors/or tape on
front and rear bumpers.
(3) Golf carts may only be operated on designated public roads during
the hours between sunrise and sunset (the hours 1/2 hour after sunrise
to 1/2 hour before sunset).
(4) All passengers must be seated.
(5) Children are not allowed on a golf cart that is operated on public
roads if by age/size they are required by state or federal regulations
to be seated in child-restraint equipment.
(6) Golf carts must be operated in single file and as close to the right-hand
side of the street as possible.
(7) The operator of a golf cart shall use hand signals when turning a
golf cart on City public roads. A hand signal for a left turn shall
be fully extending the arm straight out. A hand signal for a right
turn shall be extending the arm out at a 90° angle upwards.
(8) Golf carts shall not be allowed to operate on any sidewalks, except
as required to cross them to enter or exit public roads. Golf carts
shall not be operated in areas not designated for motor vehicle use.
This shall include, but not be limited to, public parks, public grassy
areas, and public walkways.
(9) No unattended golf cart is permitted on any public roadway while
the motor is running or a key in the ignition.
(10)
Golf carts must display a slow-moving vehicle emblem. See § 347.245,
Wis. Stat, for the standards and specifications for the design of
the emblem.
(11)
Golf cart operators are subject to all Wisconsin Statutes Chapter
346, Rules of the Road, as applicable to automobiles (including, and
in particular operating under the influence of alcohol or controlled
substances and/or traveling with open alcohol containers).
(12)
Golf carts may only be operated on roads where the speed limit
is 25 miles per hour or less.
E. Disclaimer and liability.
(1) Disclaimer. Golf carts are not designed for nor manufactured to be
operated on public streets and the City neither advocates nor endorses
the golf cart as a safe means to travel on public streets, roads,
highways, and sidewalks. The City shall not be liable for accidents,
injuries, or death involving the operation of a golf cart on public
roads.
(2) Assumption of risk. Any person who owns, operates, or rides upon
a golf cart on a public road or sidewalk within the City does so at
his or her own risk and peril and assumes all liability resulting
from the operation of the golf cart.
F. Violations and penalties.
(1) Violations of this section shall constitute a noncriminal violation
enforceable by all duly authorized law enforcement officers of the
City of Jefferson.
(2) Violation penalties shall be not less than $75 nor more than $200
plus statutory penalty assessment, jail assessment, court costs, and
crime lab assessment.
G. When effective. This section shall take effect after the passage,
publication, and attestation as required by law. This section shall
be reviewed by the Common Council on or before November 30, 2023 to
determine if the use of golf carts imperils the safety of the public
in any way.
If any provision of this article or its application to any person
or circumstances is held invalid, the invalidity does not affect the
other provisions or applications of this article.
This article shall take effect after passage, publication, and
attestation as required by law.

herein are hereby repealed. All other provisions are reaffirmed.
