The Zoning Ordinance of the Village of Wrightstown, Brown County, Wisconsin, is adopted for the following purposes: to lessen congestion in the streets; to secure safety from fire, panic and other dangers; to promote and to protect the public health, safety, comfort, convenience and welfare; to provide adequate standards of light, air and open space; to maintain the aesthetic appearances and scenic values of the Village; to prevent the overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provision of transportation, water, sewerage, schools, parks and other public requirements; and to foster a more rational pattern of relationship between residential, business, commercial and manufacturing uses for the mutual benefit of all.
The provisions of this chapter shall be held to be the minimum requirements adopted to promote the health, safety, morals, comfort, prosperity and general welfare of the Village.
It is not intended by this chapter to repeal, abrogate, annul, impair or interfere with any existing easements, covenants or agreements between parties or with any rules, regulations or permits previously adopted or issued pursuant to law, provided that where this chapter imposes a greater restriction upon the use of buildings or premises or upon the height of a building or requires larger open spaces than are required by other rules, regulations or permits or by easements, covenants or agreements, the provisions of this chapter shall govern.
A. 
Word usage. Words used in the present tense include the future. The singular number includes the plural number, and the plural number includes the singular number. The word "building" includes the word "structure." The word "shall" is mandatory and not directory. Any words not herein defined shall be construed as defined in the State and Village Building Codes.[1]

B. 
For the purposes of this chapter, certain words and terms are defined as follows:
ACCESSORY BUILDING
A building or portion of a building subordinate to the main building and used for a purpose customarily incidental to the permitted use of the main building or the use of the premises. When an accessory building is a part of the main building or is substantially attached thereto, the side yard and rear yard requirements of the main building shall be applied to the accessory building.
AGRICULTURE
The use of land for agricultural purposes, including soil tillage for the production of crops, dairying, pasturage, apiculture, horticulture, floriculture, viticulture, animal and poultry husbandry and the necessary accessory uses for packing, treating or storing the produce; provided, however, that the operation of any such accessory uses shall be secondary to the primary agricultural activities occurring thereon.
AIRPORT
Any area of land or water which is used or intended for use for the landing and taking off of aircraft and any appurtenant areas which are used or intended for use for airport buildings or other airport facilities for rights-of-way, including all necessary taxiways, aircraft storage and tie-down areas, hangars and other necessary buildings and open spaces.
ALLEY
A public or private right-of-way primarily designed to serve as secondary access to abutting properties.
APARTMENT HOUSE
See "dwelling, multiple."
AUTO WRECKING YARD
Any premises on which more than one automotive vehicle, not in running or operating condition, or parts thereof, is stored in the open.
BASEMENT
That portion of any structure located partly underground having more than 1/2 of its height below the finished lot grade.
BLOCK
A tract of land bounded by streets or by a combination of streets and public parks, cemeteries, railroad rights-of-way, shorelines of waterways or municipal boundary lines.
BOARDINGHOUSE
A building other than a hotel where meals, or lodging and meals, are furnished for compensation for three or more persons not members of a family.
BUILDING
Any structure built, used, designed or intended for the support, shelter, protection or enclosure of persons, animals, chattels or property of any kind and which is permanently affixed to the land. When a building is divided into separate parts by unpierced fire or party walls extending continuously from the ground through all stories to and above the roof, each part shall be deemed a separate building.
BUILDING, HEIGHT OF
The vertical distance from the average curb level in front of the lot or the finished grade at the building line, whichever is higher, to the highest point of the coping of a flat roof, to the deckline of a mansard roof or to the average height of the highest gable of a gambrel, hip or pitch roof.
BUILDING, TEMPORARY
Any building not designed to be permanently located in the place where it is or where it is intended to be placed or affixed. Mobile homes used as residences shall not be classified as temporary buildings. They are further defined in this section.
CARPORT
A roofed structure open on one or more sides used for the protection of vehicles.
CLINIC, MEDICAL OR DENTAL
An organization of physicians or dentists, or both, who have their offices in a common building. A clinic shall not include inpatient care.
CLUB
An association of persons for some common purpose, but not including groups organized primarily to render a service which is customarily carried on as a business. All organizations shall be recognized clubs or fraternities.
COMMERCIAL FEEDLOT
An agriculture enterprise where livestock is purchased and raised and then sold to a buyer, feedlot or slaughterhouse.
CONDITIONAL USE
A use of a special nature so as to make impractical its predetermination as a principal use in a respective zone district.
CORNER SIDE
A yard along a side lot line from front yard to rear yard when said side lot line is coterminous with a street right-of-way line.
DRIVE-IN RESTAURANT
An establishment which provides window service and carry-out counter service for food products to automotive customers. Interior seating may or may not be provided, but such seating is incidental and not the primary service area.
DWELLING
A building or portion thereof, excluding a hotel, motel and trailer, with said building or portion thereof designed or used exclusively for residential occupancy.

DWELLING, MULTIPLE
A building or portion thereof designed for and occupied by more than two families, including tenement houses, row houses, apartment houses and apartment hotels.
DWELLING, ONE-FAMILY
A detached building designed for and occupied exclusively by one family.
DWELLING, TWO-FAMILY
A building designed for and occupied exclusively by two families.
DWELLING UNIT
One or more rooms which are arranged, designed or used as living quarters for one family only. Individual bathrooms and complete kitchen facilities, permanently installed, shall always be included for each dwelling unit.
FAMILY
Any member or individual related by blood, adoption or marriage, or not to exceed two persons not so related, living together on the premises as a single housekeeping unit, including any domestic servant.
FARM
Any parcel of land which is used for gain in the raising of agricultural products, livestock, poultry and dairy products.
FRONTAGE
All the property abutting on one side of a street between two intersecting streets or all of the property abutting on one side of a street between an intersecting street and the dead end of a street.
FRONTAGE LOT
The length of all the property of such lot fronting on a street measured between the side lot lines of the lot.
FUR FARM
An agricultural operation where the major income is derived from the selling or sale of fur-bearing animals and/or pelts.
GARAGE, PRIVATE
An enclosed accessory building to the main building which provides for the storage of motor vehicles and in which no occupation, business or service for profit is carried on.
GARAGE, PUBLIC
Any building or premises, other than a storage garage, where motor-driven vehicles are repaired, serviced, hired, sold or stored.
GARAGE, STORAGE
Any building or premises used for the storage only of motor-driven vehicles, pursuant to previous arrangements and not to transients, and where no equipment, parts, fuel, grease or oil is sold and vehicles are not equipped, serviced, repaired, hired or sold. No commercial motor vehicle exceeding two tons' capacity shall be stored in any storage garage.
GRADE
The average level of the finished surface of the ground.
HOME OCCUPATION
Any occupation, except for professional offices, carried on by a member of the immediate family residing on the premises, in connection with which there is used no sign or display that will indicate from the exterior that the building is being utilized in whole or in part for any purpose other than that of a dwelling; there is no commodity sold upon the premises; no person is employed on the premises other than the member of the immediate family residing thereon; and no mechanical or electrical equipment is used except such as permissible and commonly used for purely domestic or household purposes. No accessory building shall be used for such home occupation.
HOTEL
A building in which lodging, with or without meals, is offered to transient guests for compensation and in which there are more than five sleeping rooms, with no cooking facilities in any individual room or apartment.
INDUSTRIAL PARK
A special or exclusive type of planned industrial area designed and equipped to accommodate a community of industries, providing them with all necessary facilities and services in attractive surroundings among compatible neighbors. Industrial parks may be promoted or sponsored by private developers, community organizations or government organizations.
JUNK (SALVAGE) YARD
An open area where waste or scrap material is bought, sold, exchanged, stored, baled, packed, disassembled or handled, including but not limited to scrap iron and other metals, paper, rags, rubber tires, bottles and automobiles.
KENNEL
The boarding of four or more dogs on any lot shall constitute the operation of a kennel. The boarding of offspring of any dog shall not cause a lot to be denominated as a kennel, provided that the number of dogs boarded on said lot shall be reduced to three or fewer dogs within two months of the birth of said offspring. Notwithstanding anything to the contrary, the boarding of any dog for pay for a period of more than two weeks shall constitute the operation of a kennel upon said lot.

LODGING HOUSE
A building other than a hotel where lodging is only provided for compensation for not more than three persons not members of the family.
LOT
A parcel of land having a width and depth sufficient to provide the space necessary for one main building and its accessory building, together with the open spaces required by this chapter and abutting on a public street.
LOT, CORNER
A lot abutting on two or more streets at their intersection, provided that the interior angle of such intersection is less than 135°.
LOT, DEPTH OF
The mean horizontal distance between the front and rear lot lines.
LOT, INTERIOR
A lot other than a corner lot.
LOT LINES
The lines bounding a lot as defined herein.
LOT OF RECORD
A lot which is part of a plat or certified survey map subdivision which has been recorded in the office of the Register of Deeds of Brown County or a parcel of land the deed to which was recorded in the office of said Register of Deeds prior to the adoption of this chapter.
LOT, THROUGH
An interior lot having frontage on two nonintersecting streets.
LOT, WIDTH OF
The horizontal distance between the side lot lines of a lot, measured at the narrowest width within the first 30 feet of lot depth immediately in back of the front yard setback line.
MOBILE HOME

(1) 
A structure certified and labeled as a manufactured home under 42 U.S.C. §§ 5401 to 5426 which, when placed on the site:
(a) 
Is set on an enclosed foundation in accordance with W.S.A. s. 70.043(1) and Subchapters III, IV and V of Chapter ILHR 21, Wisconsin Administrative Code, or is set on a comparable enclosed foundation system approved by the Building Inspector. The Building Inspector may require the plan to be certified by a registered architect or engineer to ensure proper support of the home.
(b) 
Is installed in accordance with the manufacturer's instructions.
(c) 
Is properly connected to utilities.
MOBILE HOME PARK
Any park, court, camp, site, lot, parcel or tract of land designed, maintained, intended or used for the purpose of supplying a location or accommodations for two or more mobile homes, and it shall include all facilities used or intended for use as part of the equipment thereof. It shall not include automobile or mobile home sales lots on which unoccupied mobile homes are parked for purposes of inspection and sale.
MOTEL
An establishment consisting of a group of attached or detached living or sleeping accommodations, with bathroom and closet space, located on a single zoning lot and designed for use by transient guests and where there is no permanent occupancy of any unit except by the owner, his or her agent or his or her employees.
MOTOR VEHICLE
Any passenger vehicle, truck, truck trailer, trailer or semitrailer propelled or drawn by mechanical power.
NONCONFORMING USE
Any use of land, building or structure, lawful at the time of the enactment of this chapter, which does not comply with all of the regulations of this chapter, or of any amendment thereto, governing use for the zoning district in which such use is located.
PARKING SPACE
A graded and surfaced area of not less than 220 square feet in area, either enclosed or open, for the parking of a motor vehicle, having adequate ingress and egress to a public street or alley, exclusive of passageways, driveways or other means of circulation or access.
PLANNED DEVELOPMENT
A tract of land which contains or will contain two or more principal buildings, developed under single ownership or control, the development of which is unique and of a substantially different character than that of surrounding areas. A planned development (sometimes called a "planned unit development") allows for flexibility not available under normal zoning district requirements.
PROFESSIONAL OFFICE
The office of a doctor, practitioner, dentist, minister, architect, landscape architect, professional engineer, lawyer, author, musician or other recognized profession. When established in a residential district, a professional office shall be incidental to the residential occupation; not more than 25% of the floor area of only one story of the dwelling unit shall be occupied by such office; and only one unlighted nameplate, not exceeding one square foot in area, containing the name and profession of the occupant of the premises shall be exhibited.
PUBLIC AIRPORT
Any airport which complies with the definition contained in W.S.A. s. 114.002(6) or (9), or any airport which serves or offers to serve carriers engaged in air transport.

ROADSIDE STAND
A structure not permanently fixed to the ground that is readily removable in its entirety, covered or uncovered and not wholly enclosed, and used solely for the sale of farm products produced on the premises. No such roadside stand shall be more than 300 square feet in ground area, and there shall be no more than one roadside stand on any one premises, and it shall be limited to a maximum height of 10 feet.
SETBACK
The minimum horizontal distance between the street line and the nearest point of a building or any projection thereof, excluding uncovered steps.
SIGN
A name, identification, description, display or illustration which is affixed to, or represented directly or indirectly upon, a building, structure or piece of land and which directs attention to an object, product, place, activity, person, institution, organization or business. However, "sign" shall not include any display of official court or public office notices, nor shall it include the flag, emblem or insignia of a nation, political unit, school or religious group. "Sign" shall not include a sign located completely within an enclosed building unless the content shall so indicate.
SIGN, ADVERTISING
A sign which directs attention to a business, commodity, service or entertainment not exclusively related to the premises where such sign is located or to which it is affixed.
SIGN, BUSINESS
A sign which directs attention to a business or profession conducted, or to a commodity, service or entertainment sold or offered, upon the premises where such sign is located or to which it is affixed.
STABLE
The same meaning as "garage," one draft animal being considered the equivalent of one self-propelled vehicle.
STORY
That portion of a building included between the surface of a floor and the surface of the floor next above it or, if there is no floor above it, the space between the floor and the ceiling next above it. A basement or cellar having 1/2 or more of its height above grade shall be deemed a story for purposes of height regulations.
STORY, HALF
The space under any roof except a flat roof which, if occupied for residential purposes, shall be counted as a full story.
STREET
All property dedicated or intended for public or private street purposes or subject to public easements therefor and 21 feet or more in width.
STREET LINE
A dividing line between a lot, tract or parcel of land and a contiguous street.
STRUCTURAL ALTERATION
Any change, other than incidental repairs, which would prolong the life of the supporting members of a building, such as the addition, removal or alteration of bearing walls, columns, beams, girders or foundations.
STRUCTURE
Anything constructed or erected the use of which requires a permanent location on the ground or attachment to something having a permanent location on the ground.
TEMPORARY STRUCTURE
A movable structure not designed for human occupancy nor for the protection of goods or chattels and not forming an enclosure.
TOURIST CAMP
A tract or parcel of land, with or without buildings or other equipment, on which one or more camp cabins are located or where temporary accommodations are provided for two or more automobile trailers or house cars, open to the public free or for a fee.
USE, PRINCIPAL
The main use of land or buildings as distinguished from a subordinate or accessory use. A principal use may be permitted, conditional or nonconforming.
VISION CLEARANCE
An unoccupied triangular space at the street corner of a corner lot which is bounded by the street lines and a setback line connecting points specified by measurement from the corner of each street line.
WIRELESS TELECOMMUNICATIONS FACILITIES
Commercial mobile radio services, unlicensed wireless services and common-carrier wireless exchange access services as described in the Federal Telecommunications Act of 1996.

YARD
An open space on the same lot with a building, unoccupied and unobstructed from the ground upward except as otherwise provided herein.
YARD, FRONT
A yard extending the full width of the lot between the front lot line and the nearest part of the main building, excluding uncovered steps.
YARD, REAR
A yard extending the full width of the lot, being the minimum horizontal distance between the rear lot line and the nearest part of the building, excluding uncovered steps.
YARD, SIDE
A yard extending from the front yard to the rear yard, being the minimum horizontal distance between a building and the side lot line.
