A. 
Unless the Mayor has issued a permit therefor, it shall be unlawful for any person to possess or transfer an open container of any alcoholic beverage in the Borough of North Wales in any of the following places:
(1) 
A public street.
(2) 
An alley.
(3) 
A sidewalk.
(4) 
A parking lot.
(5) 
Recreational places owned, leased and/or maintained by the Borough of North Wales, including parks and playgrounds.
(6) 
A motor vehicle in any of the aforementioned places.
B. 
An open container shall include, but not be limited to, any of the following types of containers:
(1) 
Glass.
(2) 
Cup.
(3) 
Bottle.
(4) 
Can.
(5) 
Carton.
C. 
An open container shall not include any of the foregoing if the container is completely covered with a cap or lid.
D. 
The Mayor may issue a permit to allow the possession and transfer of open containers of alcoholic beverages to such persons or groups, for such locations and for such periods of time which are consistent with the health, safety and welfare of the borough.
Upon conviction of a violation, a person may be sentenced to pay a fine of up to $600 or imprisoned for a term which shall be fixed by the court at not more than 30 days.
