This chapter shall be known and may be cited as the "Borough of North Wales Park Ordinance."
As used in this chapter, the following terms shall have the meanings indicated:
PARK
Any playground, recreation center or any other area within the Borough of North Wales owned, used or operated by the Borough of North Wales and devoted to active or passive recreation.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
VEHICLE
Any wheeled conveyance, whether motorized or self-propelled, including but not limited to bicycles, skateboards, roller skates, go-carts, trailers, wheelbarrows, wagons, etc. The following exhaustive list shall not, however, be considered vehicles for purposes of this chapter: baby carriages, vehicles operated by agents of the borough in the service of borough property and any vehicle designed and used to assist in the transport of handicapped individuals.
All borough parks shall be operated and maintained under the general supervision of the Borough Council and the Public Works Department. It shall be the duty of the Borough Administration, together with the North Wales Borough Police Department, to enforce the provisions of this chapter and all rules and regulations adopted thereunder.
It shall be unlawful for any person in any park to willfully mark, deface, disfigure, injure, tamper with, displace or remove any buildings, tables, benches, fireplaces, railings, paving, waterline or other public utility, or parts thereof, signs, notices or placards, whether temporary or permanent, monuments, stakes, posts or other boundary markers, or other structures or equipment facilities or appurtenances, whether real or personal.
It shall be unlawful for any person to annoy, injure or kill any animals or birds in any park, nor shall any person disturb any fowl in streams, pools or ponds or remove or carry away any bird's nest or eggs; further, it shall be unlawful for any person to injure or damage any tree, plant, shrub, fern, blossom, flower or turf.
No person shall bring in or dump, deposit or leave any bottles, broken glass, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage or refuse or other trash. No such refuse shall be placed or left on the grounds but shall be placed in proper receptacles where these are provided. Where receptacles are not provided, all such rubbish or waste shall be carried away from the park by the person or persons responsible for its presence and properly disposed of elsewhere.
It shall be unlawful for any person to carry, possess or drink any alcoholic beverage or liquor in any park.
No vehicle shall be permitted on park property, except within areas specifically designated by authorized signs permitting the use therein of certain designated vehicles.
In order to promote the health, safety, morals and general welfare in the Borough of North Wales, all recreation places owned, leased and/or maintained by the Borough of North Wales, including public parks and playgrounds in said borough, shall be closed to the public at all times between sunset and sunrise, and it shall be unlawful for any person, other than a law enforcement officer or maintenance employee of the borough, to enter or remain in said recreation place at any time between sunset of any one day and sunrise of the following day.
Any person who shall violate any provision of this chapter shall, upon prosecution and conviction thereof, be sentenced to pay a fine of not more than $600 and costs of prosecution and, in default of payment of such fine and costs, to imprisonment for not more than 30 days.
