The purpose of this chapter is to establish the hours for Town parks, cemeteries and water-access areas.

Those areas listed in the Selectmen's "Policy to protect children using Madison's athletic fields and parks" dated June 12, 2018.[1]

The Town Manager shall issue permits to persons or organizations to conduct such activities in any of the Town parks upon the applicant's meeting the following requirements:
A. 
The applicant shall agree to indemnify and hold the Town harmless from any and all claims or damages arising out of applicant's proposed activity.
B. 
The applicant shall agree to turn the subject park over to the Town following the proposed activity in the same condition it is on the date said permit was issued.
C. 
The applicant shall agree to such reasonable controls or limitations on hours of operation, noise, and types of activities, as the Town Manager may impose upon such permit.
D. 
The applicant shall provide such bonds with such sureties as the Town Manager may reasonably demand of applicant to assure applicant's compliance with the conditions and/or limitations of such permit.
Except for the designated vehicle roadways, launching ramps and parking areas, Town parks shall be closed to all motor vehicles except emergency, maintenance and law enforcement vehicles, except during events for which a permit has been granted, as stated in § 285-3, at which time vehicles used in connection with operating an event may also enter the parks.
All Town maintained cemeteries shall be closed to all persons and all vehicles except law enforcement officers and maintenance and emergency personnel and vehicles, between 1/2 hour after sunset and sunrise.
All of the above listed areas shall be closed to all persons except law enforcement officers and maintenance and emergency personnel between 1/2 hour after sunset and sunrise.
Violations of this chapter shall be punishable by a fine of not more than $100, or imprisonment of up to 10 days.
If a resident wishes to use any of the above-listed areas during the hours when such areas are closed by this chapter, a permit may be secured at the Town Manager's Office. Permits will be issued for a set period of time, and for purposes deemed reasonable by the Town Manager.
