A. 
The Town of Hampstead shall be generally exempt from all legislation of Carroll County, Maryland, which involves matters over which the Town has been granted authority pursuant to Article 23A of the Annotated Code of Maryland or pursuant to public general law or its Charter. This exemption shall extend to all legislation in existence or such legislation as may be passed from time to time by the County Commissioners of Carroll County, provided that this exemption shall not apply to any of the Chapters of the Carroll County Maryland Code of Public Local Laws and Ordinances, as adopted and amended from time to time, as enumerated below:

B. 
Where the Town determines any administrative approval or permission granted under the Ordinances listed herein may be deleterious to the public health, safety or welfare of the citizens of Hampstead, the Town shall retain the authority to stay the approval or permission for up to 90 days. The purpose of such stay shall be to allow the Town Council to conduct hearings, subpoena testimony, gather information and take any other actions deemed necessary to determine if the approval or permission constitutes a risk to the public health, safety or welfare and to make any appeal available under the ordinance or the Town-County Agreement. The enactment of such stay shall require the majority vote of the Council and be communicated to the Carroll County Commissioners within five days of passage.
