A Joint Recreation Commission is hereby established.
This Commission will be known as the "Town of Goshen Joint Recreation
Commission" and shall be composed of seven members. Two members shall
be residents of the Town and appointed by the Town Board of Goshen,
and two members shall be residents of the village and appointed by
the Village of Goshen Board of Trustees. One member shall be at-large
nominated by the Joint Recreation Commission and require the approval
of both the Town Board and Village Board of Trustees. The remaining
two members shall be elected officials (one Councilperson and one
Trustee) appointed by their respective Board.

A. Said Joint Recreation Commission will have all the
powers and authority granted by Article 13 of the General Municipal
Law.
B. The Commission will have the authority to propose
bylaws governing the administration, operation and affairs of the
Joint Recreation Commission, which shall require the approval of both
the Town Board and the Village Board of Trustees prior to becoming
effective and which may not be inconsistent with this chapter.
C. The Joint
Recreation Commission is hereby authorized to promulgate rules and
regulations as may be necessary to effectuate and/or implement the
provisions of this chapter so as to provide for the health, safety,
and welfare of all users of the parks and to regulate activities permitted
in the parks through the implementation of time, place and manner
restrictions regarding activities permitted in the parks.

The Joint Recreation Commission will develop,
operate, manage, control and maintain any and all areas and facilities
approved by and delegated to it by resolution adopted by both the
Town Board and the Village Board of Trustees.
Said areas will be developed to provide appropriate
recreation facilities for the residents of the Town and village insofar
as is possible within the budget funds to be appropriated by the parties
hereto, as hereinafter set forth.

The objectives of the Joint Recreation Commission
shall be as follows:
A. To provide recreation facilities and programs for
the inhabitants of the Town and village, and Goshen School District
where space permits.
B. To operate, manage, control and maintain said facilities
to obtain the maximum recreational use therefrom, and to ensure that
the facilities are maintained in such a manner as to be attractive
in appearance and serve the general health and welfare of the inhabitants
of the Town and village.
The Joint Recreation Commission will be responsible
for hiring or otherwise obtaining personnel and for leasing, buying
and otherwise obtaining materials and equipment to carry out the objectives
of the Joint Recreation Commission.
Any provision herein contained to the contrary
notwithstanding, the Joint Recreation Commission will carry out its
functions within a budget submitted in compliance with § 244-d
of the General Municipal Law.
The proportionate share to be appropriated by
each municipality shall be 50% of the total budget of the Joint Recreation
Commission.
The fiscal officer of the Town will serve as
the fiscal officer of the Joint Recreation Commission until December
31, 1970, after which the fiscal officer of the village will serve
as fiscal officer of the Joint Recreation Commission for two years
and the fiscal officers of the Town and village will alternate for
the two-year terms thereafter.

A. No person
shall enter or remain in a public park in the Town of Goshen between
sunset and sunrise the following day, except where a person is a spectator
or participant in an event or activity under the direct supervision
of or sponsored by the Joint Recreation Commission, or an event or
activity expressly authorized and allowed in the park by the Joint
Recreation Commission, when the hours of said event or activity extend
beyond sunset. Any person found in a park after sundown, except in
the circumstances described above, shall be in violation of this section.
B. For the
safety of residents and park users, the Joint Recreation Commission
may close, restrict or render unavailable for access or use parks
of any portion or portions thereof and park facilities for such interval
of time as may be deemed appropriate or necessary. Such closing may
be accompanied by the posting of notices and/or signs to such effect
upon the affected property and/or facilities and otherwise may best
give notice of same to the public.

No person, firm or corporation shall sell or offer for sale
within the public parks any property, activity or privilege whatsoever
unless authorized by the Joint Recreation Commission. This requirement
for prior authorization by the Joint Recreation Commission shall include
photography sessions, athletic clubs or training, and all other commercial
business.
