For the purpose of this chapter, the following
words and phrases shall have the meanings ascribed to them in this
section, unless different meanings are clearly indicated by the context:
ASHES
The residue from burning wood, coal, coke or other combustible
materials.
DIRECTOR
The Director of Public Works of the Village of Victor or
his authorized representatives.
DUMPSTER
A bulk waste material storage container that is designed
to be mechanically emptied into a larger compactor-type truck for
disposal.
GARBAGE
Putrescible animal and vegetable waste resulting from the
handling, preparation, cooking and consumption of food in any private
dwelling house, multiple dwelling, hotel, restaurant, building or
institution.
LITTER
Garbage, refuse and rubbish, as may be defined herein, and
other waste material which is thrown or deposited on property within
the Village not in conformance with this chapter and which tends to
create a danger to the public health, safety and welfare.
PERSON
Includes an individual or individuals in partnership or corporations,
receivers, executors or administrators of any estate.
PORTABLE REFUSE CONTAINER
A generic waste receptacle such as a garbage can or refuse
tote designed to be moved to the point of collection.
REFUSE and RUBBISH
Nonputrescible solid wastes (excluding ashes) consisting
of yard clippings, paper materials, bottles, tin cans, glass, plastic
materials, crockery and similar waste materials.
TOTER
A specific portable refuse container, purchased through the
Village, which has a ninety-six-gallon capacity.
Quantities of garbage, ashes, refuse and rubbish
to be collected are limited as follows:
A. Christmas trees. All Christmas trees shall be placed
at the curb area and will be collected at a specific location during
the month of January of each year. Such trees do not have to be cut
in three-foot lengths.
B. Leaves. Leaves may be placed in piles in front of
the premises between the sidewalk line and the curbline on scheduled
collection days to be determined by the Director during the year.
C. Large household items. All large discarded items,
such as appliances, furniture, bicycles, sleds, toys, etc., will be
collected from the curb area only by a special vehicle on scheduled
days during the year.
D. Ashes. Ashes must be thoroughly watered, quenched
and placed in a fireproof metal receptacle weighing not more than
75 pounds when filled, and placed with rubbish for collection.
F. Recycling. Property owners and occupants shall follow
the recycling regulations as established by Ontario County Recycling.
No person, other than an authorized employee
or agent of the Village or a private collection agency authorized
by the owner or occupant of the property, shall disturb or remove
any garbage, ashes, refuse, rubbish, paper or boxes that have been
placed outside of a private house, multiple dwelling, apartment house,
business or commercial building or lot for removal.
Violation of any provision of this chapter shall
be an offense against the chapter and shall be punishable by a fine
of not more than $250 or imprisonment for a period not to exceed 15
days for each offense, or by both fine and imprisonment; and each
day that said violation shall be permitted to exist shall constitute
a separate offense. Obedience to this may be enforced by injunction.
