[HISTORY: Adopted by the Board of Trustees of the Village of Victor 2-5-1968 by L.L. No. 3-1968; amended in its entirety 6-16-2008 by L.L. No. 1-2008. Subsequent amendments noted where applicable.]
For the purpose of this chapter, the following words and phrases shall have the meanings ascribed to them in this section, unless different meanings are clearly indicated by the context:
ASHES
The residue from burning wood, coal, coke or other combustible materials.
DIRECTOR
The Director of Public Works of the Village of Victor or his authorized representatives.
DUMPSTER
A bulk waste material storage container that is designed to be mechanically emptied into a larger compactor-type truck for disposal.
GARBAGE
Putrescible animal and vegetable waste resulting from the handling, preparation, cooking and consumption of food in any private dwelling house, multiple dwelling, hotel, restaurant, building or institution.
LITTER
Garbage, refuse and rubbish, as may be defined herein, and other waste material which is thrown or deposited on property within the Village not in conformance with this chapter and which tends to create a danger to the public health, safety and welfare.
PERSON
Includes an individual or individuals in partnership or corporations, receivers, executors or administrators of any estate.
PORTABLE REFUSE CONTAINER
A generic waste receptacle such as a garbage can or refuse tote designed to be moved to the point of collection.
REFUSE and RUBBISH
Nonputrescible solid wastes (excluding ashes) consisting of yard clippings, paper materials, bottles, tin cans, glass, plastic materials, crockery and similar waste materials.
TOTER
A specific portable refuse container, purchased through the Village, which has a ninety-six-gallon capacity.
A. 
All garbage, refuse, rubbish, litter and waste materials accumulated in the Village, except as limited and prohibited by § 94-6 of this chapter, shall be collected, conveyed and disposed of under the supervision of the Director, who shall have the authority to make regulations concerning the days of collection, type, size and location of disposal containers and such other matters pertaining to collection, conveyance and disposal as he shall find necessary.
B. 
The Director shall have the authority to change and modify any regulations after due notice to all concerned.
C. 
The provisions of this Code shall not be deemed to nullify any provisions of local, state or federal laws and regulations.
D. 
The Code Enforcement Officer shall have the authority to enforce all provisions of this chapter.
A. 
Garbage originating in private dwellings, multiple dwellings and apartments shall be drained of surplus water and shall be securely wrapped in wrapping paper or several thicknesses of newspaper or plastic and shall be deposited in a can or receptacle as herein defined. Garbage originating in institutions, hotels, restaurants or cafeterias shall be drained of surplus water and shall be deposited in standard refuse containers.
B. 
It shall be the duty of every person having the management or control of or occupying any land or building to provide, for the exclusive use of such land or building or part thereof, sufficient receptacles to hold garbage, ashes and rubbish ordinarily accumulated by the occupants of such land or building, and allocate an area for storage of such receptacles in the interval between regular collections. Any waste material other than garbage, ashes, refuse and rubbish which cannot be readily deposited in any receptacles may be compacted and securely bundled, tied or packed as to be easily handled, but shall not weigh more than 75 pounds, and may be placed alongside or in place of regular receptacles. Such packages or bundles shall not exceed three feet in length. Any solid waste placed in bags must be placed in heavyweight clear plastic bags.

C. 
Ashes. Ash containers shall be made of metal.
D. 
Portable refuse receptacles shall be containers commercially manufactured for that purpose, equipped with suitable handles and tight-fitting covers and shall be watertight. No more than three thirty-two-gallon receptacles shall be placed at any one property collection point, unless otherwise specified in this chapter. The receptacles shall not total more than 100 gallons' capacity. No one receptacle shall exceed 75 pounds total weight when filled.
E. 
Such containers shall be provided by the owner, tenant, lessee or occupant of the premises. Such containers shall be kept covered with suitable covers and maintained in a sanitary condition by periodic cleaning. Any container that does not conform to the provisions of this chapter or that may have ragged or sharp edges or any other defect liable to hamper or injure the person collecting the contents shall be promptly replaced upon notice. The Director shall have authority to refuse collection for failure to comply herewith.
A. 
Where curb service is provided, garbage, ashes, refuse and rubbish containers shall be placed for collection in an accessible area between the sidewalk line and the curbline in front of the premises.
B. 
The Director of Public Works may authorize the removal of garbage, ashes, refuse and rubbish from the receptacles at storage areas, provided that such storage areas are accessible to the collection vehicle and collection in this manner will, in his opinion, result in a more expeditious removal of the garbage, ashes, refuse and rubbish accumulated from such receptacles.
A. 
Village employees, under the direction of the Director, shall make a regular collection of all garbage, ashes, refuse and rubbish once a week during specified hours as prescribed by the Director of Public Works. Collection shall be made from the receptacles when placed in front of any premises between the sidewalk line and the curbline or at any such accessible location as may be designated by the Director.
B. 
The Director shall omit from collection from any premises where a dangerous dog is permitted to run at large or where Village equipment or employees of the Village are subject to any unnecessary danger or hazard.

C. 
No employee of the Village in the course of his duties shall be required to enter a building or structure to gather or collect any garbage, ashes, refuse or rubbish.
D. 
No person shall prevent or interfere with any Village employee in the sweeping or cleaning of any street, sidewalk or right-of-way or in the removal therefrom of sweepings, litter, snow, ice or other refuse material.
Quantities of garbage, ashes, refuse and rubbish to be collected are limited as follows:
A. 
Christmas trees. All Christmas trees shall be placed at the curb area and will be collected at a specific location during the month of January of each year. Such trees do not have to be cut in three-foot lengths.
B. 
Leaves. Leaves may be placed in piles in front of the premises between the sidewalk line and the curbline on scheduled collection days to be determined by the Director during the year.
C. 
Large household items. All large discarded items, such as appliances, furniture, bicycles, sleds, toys, etc., will be collected from the curb area only by a special vehicle on scheduled days during the year.
D. 
Ashes. Ashes must be thoroughly watered, quenched and placed in a fireproof metal receptacle weighing not more than 75 pounds when filled, and placed with rubbish for collection.

F. 
Recycling. Property owners and occupants shall follow the recycling regulations as established by Ontario County Recycling.
A. 
Use of barrels, drums, kegs, cardboard boxes or cloth bags for garbage containers is prohibited.
B. 
Empty receptacles shall be removed from the curb area within 12 hours after collection and shall not be put out more than 24 hours before collection.
C. 
Garbage, ashes, refuse and rubbish receptacles shall be stored on private property in a location adjacent to a principal or accessory use building, but in no case shall such receptacle be stored in front of the building line of the principal structure.
D. 
Receptacles shall not be placed for collection inside or within any building, accessory use building or garage or any place above or below ground level.
E. 
Properties situated between South High and Church Street are required, at the discretion of the Director, to use a minimum of one toter, but no more than two toters, per building.
A. 
Applicability
(1) 
The use of dumpsters is encouraged in all commercial uses.
(2) 
The use of dumpsters for single family homes shall be limited to temporary uses, not to exceed 45 days within a calendar year.
B. 
Collection schedule.
(1) 
The property owner, lessee and user of the dumpster shall make provisions that the size of the dumpster is of sufficient capacity to hold all garbage and refuse materials until emptied.
(2) 
No dumpster shall be delivered, removed or emptied between the hours of 6:00 p.m. and 6:00 a.m.
C. 
Location, use, condition and appearance.
(1) 
Dumpsters shall be situated on a pad or other hard surface.
(2) 
All dumpsters shall be kept in good repair, be structurally sound, and leakproof.
(3) 
All dumpsters shall be clearly identified with the name of the owner of the dumpster.
(4) 
The dumpster lessee shall be responsible for maintaining the area around the dumpster in good order, including removing any litter, debris, garbage, refuse, or other matter related to the use of the dumpster.
(5) 
All dumpster doors shall remain operable and shall remain securely closed except when being filled or emptied.
(6) 
Food waste placed in dumpsters shall first be in securely sealed plastic bags.
No person, other than an authorized employee or agent of the Village or a private collection agency authorized by the owner or occupant of the property, shall disturb or remove any garbage, ashes, refuse, rubbish, paper or boxes that have been placed outside of a private house, multiple dwelling, apartment house, business or commercial building or lot for removal.
A. 
No person shall deposit any garbage, ashes, refuse, rubbish, trees, cuttings or any offensive substances, except fertilizer, on any lot or plot in the Village, except in containers or as otherwise provided for in this chapter.
B. 
It shall be unlawful to dispose any refuse collected with the Village of Victor at other location other than designated by this chapter or by the Director.
A. 
Materials not acceptable.
(1) 
The following refuse shall not be considered for collection:
(a) 
Materials resulting from the repair, construction, alteration or excavation of buildings or structures, streets or sidewalks, such as sod, dirt, earth, plaster, mortar, concrete, stones, bricks, lath and roofing materials.
(b) 
Cleaning establishment waste.
(c) 
High-combustible materials.
(d) 
Solid waste resulting from industrial processes.
(e) 
Poisons, acids and explosive materials.
(f) 
Junk automobiles.
(g) 
Branches and tree stumps, unless they are split in sections six inches or less in diameter and three feet or less in length.
(2) 
Removal of such debris shall be arranged privately.
B. 
The Director has the right to refuse collections of other waste materials which, in his opinion, the Village is not equipped to collect and dispose of.
A. 
Garbage collection vehicles shall be completely enclosed and watertight.
B. 
Rubbish collection vehicles wherein no garbage is transported may be of an open refuse-collection type, provided that such vehicles are fitted with suitable canvas or other cover to prevent any materials from them being discharged while such vehicles are in transit.
C. 
Collections are to be made in such manner so as not to permit debris, litter and the like to fall upon property, public or private, or upon any highway within the Village.
D. 
All accessory doors, including the main loading door, shall be closed in travel on public highways unless said vehicle is engaged in a continuous servicing of adjacent structures on said highway.
E. 
Collection vehicles shall be kept in dean and sanitary condition, both inside and outside, and shall be subject to inspection by the Director of Public Works or his representatives.
Violation of any provision of this chapter shall be an offense against the chapter and shall be punishable by a fine of not more than $250 or imprisonment for a period not to exceed 15 days for each offense, or by both fine and imprisonment; and each day that said violation shall be permitted to exist shall constitute a separate offense. Obedience to this may be enforced by injunction.
