Pursuant to the provisions of N.J.S.A. 2B:12-1 et seq., a Municipal
Court is hereby established for the Township of Carneys Point. The
jurisdiction of the Carneys Point Township Municipal Court shall be
coextensive with the territory of Carneys Point Township.
The name of the Municipal Court shall be "Carneys Point Township
Municipal Court."
The Carneys Point Township Municipal Court shall adopt and maintain
a seal, which shall bear the impress of the name of the Court.
The Judge of the Carneys Point Township Municipal Court shall
be appointed by the Carneys Point Township Committee. The Judge of
the Carneys Point Township Municipal Court shall serve for a term
of three years from the date of appointment and until a successor
is appointed and qualified.
The Carneys Point Township Committee shall appoint a Municipal
Court Administrator and such Deputy Municipal Court Administrators
and other personnel as shall be required to efficiently operate the
Carneys Point Township Municipal Court.
The Carneys Point Township Municipal Court shall possess and
exercise all of the functions, powers, duties and jurisdiction conferred
upon it by the statutes of the State of New Jersey.
Carneys Point Township shall furnish all facilities which shall
be required for the proper administration of justice by the Carneys
Point Township Municipal Court.
The Carneys Point Township Committee shall establish and fix
the salaries and other compensation to be paid to the Judge, Municipal
Court Administrator, Deputy Municipal Court Administrators and all
other personnel employed in connection with the Carneys Point Township
Municipal Court.
All fines, costs, fees, penalties and forfeitures, including
forfeitures of bail, imposed by the Carneys Point Township Municipal
Court, and any other funds which are distributable to a local municipality,
shall be paid over and forwarded to the Chief Financial Officer for
Carneys Point Township.
The Carneys Point Township Municipal Court shall be effective
and commence on April 1, 2011. On April 1, 2011, the Carneys Point
Joint Municipal Court shall be abolished and its functions, powers
and duties, records and pending cases shall be transferred to the
Carneys Point Township Municipal Court, except as hereinafter set
forth. All functions, powers and duties, records and matters filed
with the Oldmans Township Municipal Court prior to its merger with
the Carneys Point Township Court shall be transferred to the Mid-Salem
County Municipal Court for resolution and/or appropriate disposition.
Any person who shall apply for appointment of the Municipal
Public Defender shall pay a fee of $200. The Municipal Judge may waive
a portion of the application fee or the application fee in its entirety
upon good cause shown. All application fees collected pursuant to
this chapter shall be deposited into a dedicated fund to be administered
by the Chief Financial Officer of Carneys Point Township. Said funds
shall be used exclusively to meet the costs incurred in providing
the services of the Public Defender and, when required, expert and
lay investigation and testimony pursuant to the provisions of N.J.S.A.
2B:24-17.

Carneys Point and Pennsville shall hereby establish a Joint
Municipal Court to be known as the Carneys Point-Pennsville Joint
Municipal Court and said Municipal Court is hereby approved.
A Shared Services Agreement entitled "Agreement Between the
Township of Carneys Point and the Township of Pennsville to Establish
the Carneys Point-Pennsville Joint Municipal Court," hereafter referred
to as the "agreement," which agreement is on file in the Office of
the Carneys Point Municipal Clerk, Carneys Point Municipal Building,
303 Harding Highway, Carneys Point, New Jersey 08069 and available
for public inspection between 8:30 a.m. and 4:30 p.m. Monday through
Friday is hereby authorized to be entered into by the Township of
Carneys Point and the Mayor and Township Clerk who are authorized
to sign same as evidence of authorization.
The jurisdiction of the Carneys Point-Pennsville Joint Municipal
Court shall be coextensive with the territories of Carneys Point and
Pennsville in the County of Salem, New Jersey.
The Judge of the Carneys Point-Pennsville Joint Municipal Court
shall be nominated and appointed by the Governor of the State of New
Jersey, with the advice and consent of the senate of the State of
New Jersey, and shall serve for a term of three years from the date
of appointment and until a successor is appointed and qualified.
The Administrator, Deputy Administrator(s), Prosecutor, Public
Defender and all other personnel shall be appointed in accordance
with the agreement.
The Carneys Point-Pennsville Joint Municipal Court shall become
effective and commence on January 1, 2020 and on that date the Pennsville
Municipal Court shall be abolished and their functions, powers and
duties, records and pending cases shall be transferred to the Carneys
Point-Pennsville Joint Municipal Court established pursuant to this
article and by similar ordinances adopted by the Township of Pennsville.
Carneys Point shall furnish all facilities as set forth in the
agreement.
Compensation for the Judge, Administrator, Deputy Administrator,
Prosecutor, Public Defendant and all other personnel for the Carneys
Point-Pennsville Joint Municipal Court shall be established pursuant
to the agreement.
All expenses for the operation of the Carneys Point-Pennsville
Joint Municipal Court and the payment of those expenses shall be established
in accordance with the agreement.
All fines, costs, fees, penalties and forfeitures, including
forfeitures of bail, imposed by the Carneys Point-Pennsville Joint
Municipal Court and any other funds shall be handled in accordance
with the agreement.
The term of the Carneys Point-Pennsville Joint Municipal Court
shall be as set forth in the agreement.
The provisions of this article may be subject to modification
from time to time and may be amended by the parties by mutual agreement,
including the adopting of duplicate resolutions, or ordinances when
necessary, by the respective municipality.
All employees of the Carneys Point-Pennsville Joint Municipal
Court shall receive an annual salary as set forth in the annual budget
which is established pursuant to the agreement.
