A. The fee
for construction and related permits shall be the sum of the fees
listed in N.J.A.C. 5:23-4.19; 5:23-4.20; 5:23-12.5 and 5:23-12.6,
as such sections may be amended or modified from time to time. The
fee schedule shall be on file in the Construction Office.
B. The
fee for a construction permit shall be the sum of the fees listed
in this section of the Carneys Point Township Code and shall be paid
before the permit is issued.
(1) General fees.
(a) Administrative surcharge. In order to provide sufficient funds for
proper administration of the Construction Code Office, an administrative
surcharge shall be collected, in addition to other applicable fees,
for plumbing subcode, electrical subcode and fire subcode permits.
The administrative surcharge shall be in the amount of 30% of the
total permit fees required by this chapter.
(b) New Jersey State permit surcharge fee. The New Jersey State permit
surcharge fee shall be as follows:
[1] For new buildings and additions: $0.00371 per cubic foot of volume.
[2] For all other construction: $1.90 per $1,000 of value of construction.
[3] No New Jersey permit surcharge fee shall be assessed for preengineered
systems of commercial farm buildings, for asbestos or lead abatement
or for the construction or rehabilitation of residential units that
are restricted to households of low and moderate income.
[4] Demolition of storage tanks.
[a] R-3 and R-5 use groups: UST $92; AST $46.
[b] All other use groups: UST $168; AST $84.
[5] Fireplaces.
[a] Venting/metal chimney: $65.
[6] The fee for a certificate of occupancy for all use groups other than
R-3 and R-5 shall be 10% of the permit subcode fees.
[7] Minimum fees. There shall be a minimum fee of $52 per technical section.
Residential water heaters shall be exempt from minimum fees.
[8] Any permit issues and fees not addressed in this chapter shall be
determined by the Construction Code Official and the appropriate subcode
official.
(c)
New construction and additions fee. The fee to be charged in
connection with new construction and additions shall be as follows:

For all use groups except those identified in Subsection
B(1)(c)[2] and
[3] of this section: $0.038 per cubic foot of volume.

For Use Groups A-1, A-2, A-3, A-4, A-5, F-1, F-2, S-1 and S-2:
$0.015 per cubic foot of volume.

For structures on farms including commercial farm buildings
provided; however, that the fees to be assessed pursuant to this subsection
shall not exceed $1,145: $0.008 per cubic foot of volume.
(2) Renovations, alterations and repairs and/or site construction associated
with pre-engineered systems of commercial farm buildings, premanufactured
construction and the external utility connection for premanufactured
construction shall be based upon the estimated cost of work. Fees
shall be charged as follows:
(a) Estimated cost up to and including $50,000: $24 per $1,000.
(b) Estimated cost from $50,001 up to and including $100,000: $18 per $1,000, in addition to the fees assessed pursuant to Subsection
B(2)(a).
(c) Estimated cost in excess of $100,000: $15 per $1,000, in addition to the fees assessed pursuant to Subsection
B(2)(a) and
(b).
(3) Swimming pools. Fees shall be charged as follows:
(a) Aboveground swimming pool with surface area greater than 550 square
feet: $210.
(b) Aboveground swimming pool with surface area 550 square feet or less:
$70.
(c) In-ground swimming pool:
[1] With surface area greater than 550 square feet: $210.
[2] With surface area 550 square feet or less: $106.
(d)
Storable pools, spas and/or hot tubs: $46.
(4) Demolition and removal of buildings and structures. Fees shall be
charged as follows:
(a) Structures of less than 5,000 square feet and less than 30 feet in
height, one- and two-family residences: $65.
(b) All other use groups (including tanks): $120.
(5) Signs. Fees shall be charged as follows:
(a) Fees for pylon signs shall be $4 per square foot for the first 100
square feet, $3 per square foot for the next 400 square feet and $2
per square foot thereafter, but not less than $46.
(b) Fees for ground signs or wall signs shall be $2 per square foot for
the first 100 square feet, $1.50 per square foot for the next 400
square feet and $1 per square foot thereafter, but not less than $46.
(6) Plumbing. The fees to be charged in connection with work regulated
pursuant to the Plumbing Subcode shall be as set forth in the New
Jersey Administrative Code.
(7) Electrical.

(8) Fire. The fees to be charged in connection with work regulated pursuant
to the Fire Subcode shall be as set forth in the New Jersey Administrative
Code.
(9) Cross connections and backflow preventers. The fee for annual inspections
of cross connections and backflow preventers shall be $46 per each
device.
(10) Certificate of occupancy. The fee to be charged for a certificate
of occupancy issued pursuant to this chapter shall be $30 for R-3
and R-5 Use Groups. The fee for a certificate of occupancy for all
other use groups shall be 10% of the permit subcode fees.
(11) Certificate of continued occupancy. The fee to be charged for a certificate
of continued occupancy shall be $151.
(12) Certificate of occupancy pursuant to change of use. The fee to be
charged for a certificate of occupancy issued pursuant to a change
of use shall be $120.
(13) Renewal of temporary certificate of occupancy. The fee to be charged
for a renewal of a temporary certificate of occupancy shall be $30
for R-3 and R-5 Use Groups. The fee to be charged for a renewal of
a temporary certificate of occupancy for all other use groups shall
be 10% of the permit subcode fees.
(14) Application for a variation. The fee to be charged for an application
for a variation, in accordance with N.J.A.C. 5:23-2.10, shall be $594
for Class I structures and $120 for Class II and Class III structures.
The fee to be charged for resubmission of an application for a variation
shall be $229 for Class I structures and $65 for Class II and Class
III structures.
(15) Elevators, escalators and moving walks. The fees to be charged for
elevators, escalators and moving walks shall be as set forth in the
New Jersey Administrative Code.
(16) Mechanical.

(a) Condensing unit (outside AC): $50.
(h) Direct replacement generator: $65.
C. The Construction
Official shall, with the advice of the subcode officials, prepare
and submit to the Township Committee of Carneys Point Township, biannually,
a report recommending a fee schedule based on the operating expenses
of the agency and any other expenses of the municipality fairly attributable
to the enforcement of the State Uniform Construction Code Act.
D. No person
shall be charged a construction permit surcharge fee or enforcing
agency fee for any construction, reconstruction, alteration or improvement
designed and undertaken solely to promote accessibility by disabled
persons to an existing public or private structure or any of the facilities
contained therein. A disabled person, or a parent or sibling of a
disabled person, shall not be required to pay any municipal fee or
charge in order to secure a construction permit for any construction,
reconstruction, alteration or improvement which promotes accessibility
to his own living unit. For purposes of this section, “disabled
person” means a person who has the total and permanent inability
to engage in any substantial gainful activity by reason of any medically
determinable physical or mental impairment, including blindness, and
shall include, but not be limited to, any resident of this state who
is disabled pursuant to the federal Social Security Act (42 U.S.C.
§ 416, as amended) or the federal Railroad Retirement Act of
1974 (45 U.S.C. § 231 et seq., as amended) or is rated as having
a sixty-percent disability or higher pursuant to any federal law administered
by the United States Veterans’ Act. For purposes of this subsection,
“blindness” means central visual acuity of 20/200 or less
in the better eye with the use of a correcting lens. An eye which
is accompanied by a limitation in the fields of vision such that the
widest diameter of the visual field subtends an angle no greater than
20° shall be considered as having a central visual acuity of 20/200
or less.
The Office of Housing and Inspection and the
Construction Board of Appeals established herein may adopt rules and
regulations for their internal governance not inconsistent with any
specific provision of Part III of the New Jersey State Uniform Construction
Code or with its stated intent or with this chapter.
This article shall be known and may be cited
as the "State Uniform Construction Code Enforcement Ordinance" of
Carneys Point Township.
