A. 
Independent boards and agencies provide important governmental services in the Township. In the governmental framework they are hybrids possessing features consistent with executive, legislative and judicial branches. Each board is designed to function in areas of particular expertise. Each board covers a limited area of knowledge, but becomes most specialized in its handling of its matters. Boards are necessary and important elements in Delanco Township's government which assist in bringing good services to the inhabitants of the community.
B. 
Various Township independent boards and agencies have the right pursuant to the statute to appoint employees to carry out the functions of the Board. Such employees hold positions within the Township governmental structure. All positions under a board or agency of the Township shall be subject to the provisions of civil service laws, except for the following:
(1) 
Volunteer personnel and personnel appointed to serve without compensation.
(2) 
Consultants and counsel rendering temporary professional service.
(3) 
All positions set forth within the board sections of this article which are accompanied by a verbal statement concerning the appointment, qualifications and duties of the position; where only a position is listed without further verbal statement, the position is a civil service appointment and is more particularly described on a job title description prepared by the Department of Civil Service, said description being on file in the office of the Township Clerk and available for inspection.
(4) 
All other offices or positions that are so classified by state statute or by the Civil Service Commission pursuant to N.J.A.C. 4:1-6.7.
(5) 
All officers of an independent board or agency who are members of the independent board or agency, whether paid or not paid.
The provisions of Part II, Land Use Procedures, of the Code of the Township of Delanco which deal with the creation of a Planning Board are hereby saved from repeal, renumbered in accordance with this chapter and incorporated herein by reference.

A. 
Board established; terms of office. A Board of Recreation Commissioners consisting of seven members and two alternates who shall be residents of the Township of Delanco is hereby established. Said Commissioners will serve without compensation. The Commissioners will be appointed by resolution of the Township Committee or until their successors are appointed and qualified. Commencing December 1, 1965, their terms of office shall be as follows: two for the term of one year, two for the term of two years, one for the term of three years, one for the term of four years, and one for the term of five years; and at the expiration of the term of service of each member of such Commission, others shall be appointed in the place of those whose terms expire, in the same manner, and until their successors have qualified; so that the term of service of all the members of such Commission hereinafter appointed shall be for the term of five years. Any vacancies occurring in such Commission shall be filled by appointment as aforesaid for the unexpired term only.

B. 
Oath of office; election of officers. Each Commissioner shall, within 10 days of his or her appointment, take and subscribe an oath or affirmation before the Township Clerk, faithfully to discharge the duties of his or her office to the best of his or her skill and understanding. They shall elect a Chair from their membership immediately who will hold office until December 31 next or until his or her successor is elected. Thereafter, a Chair shall be elected annually. Each member of the Commission shall devote such time and attention to the faithful performance of the duties of his or her office as the public interest may require. Regular monthly meetings of the Commission shall be held at the call of the Chair.

C. 
Powers and control. The Recreation Commissioners shall have control and management of all public parks, lands and premises and shall establish rules and regulations for the government and management of said park property.
D. 
Personnel. In addition to the personnel set forth above, the Board shall have the following personnel:
(1) 
Secretary to the Board.
(2) 
Recreation Chairperson.
(3) 
Summer Recreation Supervisor.
E. 
Delanco Youth Sports Association (DYSA). DYSA is hereby authorized, by the Township Committee, to be the provider of youth sports (baseball, softball, basketball and soccer) within the Township of Delanco. DYSA shall notify the Township Committee each year, by letter, no later than January 31, of the names and titles of individuals elected to office, pursuant to DYSA bylaws. These duly elected officers will serve and be recognized as liaisons to the Township Committee. The Township Committee shall not make appointments to DYSA, and DYSA shall retain full control over appointment of its officers in accordance with its bylaws.

A. 
Appointment of members.
(1) 
There shall be one member who shall also be a member of the Delanco Township Planning Board and who shall be appointed for a term of one year from January 1 to December 31. The Delanco Township Planning Board may submit a recommendation to the Township Committee by December 15.

(2) 
There shall be one member who shall also be a member of the Delanco Township Shade Tree Commission and who shall be appointed for a term of one year from January 1 to December 31. The Delanco Shade Tree Commission may submit a recommendation to the Township Committee by December 15.

(3) 
There shall be five members, and at the time of the amendment of this chapter to increase the general membership from three to five, the two new members shall be appointed to staggered terms such that one shall be appointed for an initial term of two years, and one shall be appointed for a term of three years. Thereafter, all five of these general members shall be appointed for terms of three years except as otherwise herein provided. The terms shall be from January 1 of the first day of the term to December 31 of the year of expiration of the term.

(4) 
Any vacancy occurring other than the expiration of a term shall be filled for the unexpired term in the same manner as the original term.
(5) 
A member who, subsequent to his or her appointment, shall move from the Township of Delanco shall immediately vacate and forfeit his or her membership on the Delanco Environmental Advisory Board, and the seat shall be deemed vacant until an appointment is made by the Township Committee to fill the unexpired term of the vacated seat.
B. 
Powers and duties. The powers and duties of the Delanco Environmental Board shall be as follows:
(1) 
To promote the conservation and development of the environmental quality of the Township of Delanco.
(2) 
To plan, implement and inform the public about local conservation programs.
(3) 
To compile and keep an index of all open areas, publicly or privately owned, including open marshlands and other wetlands.
(4) 
To recommend to the Planning Board plans and programs for inclusion in a Municipal Master Plan for the development and use of such areas.
(5) 
To inform the public of ways and means of promoting and encouraging the betterment of the quality of our environment.
(6) 
To identify all scenic, historic, park and recreation sites and make recommendations for their protection and improvement.
(7) 
To act as the coordinating agency of the community on conservation matters and as liaison for local environmental needs between local, regional, state and federal agencies administering to those needs.
(8) 
To advise the Township Committee as to the environmental and ecological needs of the Township, including but not limited to a semiannual assessment report to be submitted on or before the first day of January and on or before the first day of July.
C. 
The Township Committee does hereby establish and set forth the membership, purpose and duties of the Delanco Township Environmental Advisory Board.
D. 
The Township Committee may, if deemed necessary, appropriate funds for the expenses incurred by the Delanco Township Environmental Advisory Board and that any expenses incurred by the Environmental Advisory Board, in part or in full, shall not exceed the amount appropriated to the Environmental Advisory Board.
E. 
The Delanco Township Environmental Advisory Board shall provide for its own organization as it may deem desirable. The Environmental Advisory Board shall organize as of January 1, 1994 after the Delanco Township Committee sets forth the appointments to the Environmental Advisory Board in December 1993.
F. 
The Township Committee of the Township of Delanco shall periodically review the actions and achievements of the Delanco Township Environmental Advisory Board and amend the membership, purpose and/or duties of the Environmental Advisory Board as it deems necessary.
A. 
Creation. Pursuant to N.J.S.A. 44:8-115 there is hereby created a Local Assistance Board within the Township of Delanco.
B. 
Organization.
(1) 
Membership. The Board shall be composed of five persons, at least one of whom shall be a woman and only one of whom may be a member of the governing body.
(2) 
Appointment. The Board shall be appointed by the Township Committee.
(3) 
Terms.
(a) 
Committee members. The Committee member to the Board shall be appointed for a one-year term.
(b) 
Other members. Other members of the Board shall be appointed for a four-year term, so structured initially, however, that one member's term will expire each year.
(c) 
Commencement of term. The term of each member shall begin on the first day of January and shall continue until the member's successor is appointed and qualified.
(4) 
Vacancies. Vacancies to the Board shall be filled for the unexpired term only.
C. 
Duties and powers. It is the responsibility of the Local Assistance Board to enforce and administrate the Public Assistance Law for the State of New Jersey within Delanco Township. In this connection the Board shall:
(1) 
Organize annually and from its members select a Chair and Secretary.
(2) 
Meet periodically at the call of its Chair to review the operation of public assistance within the Township.
(3) 
Appoint a Director of Welfare.
D. 
Director of Welfare.
(1) 
Appointment. The Board shall appoint a Director of Welfare.
(2) 
Term. The Director shall hold office for a term of five years from the date of appointment.
(3) 
Compensation. The Director shall be paid such a salary as may be fixed by the Board subject to the approval of the Township Committee.
(4) 
Vacancy. In case of vacancy in the office of Director of Welfare, one temporary or acting Director may be appointed by the Board to serve for not more than 90 days.
(5) 
Duties. The Director shall:
(a) 
Be the first executive administrative officer of the Board.
(b) 
Supervise by periodic investigation every person receiving public assistance, such investigation to be made by visitation at least once a month.
(c) 
Reconsider from month to month the amount and nature of public assistance given and alter, amend or suspend the same when the circumstances so require.
(d) 
Devise ways and means for bringing persons unable to maintain themselves to self-support or to the support of any other person or agency able and willing to do so.
(e) 
Keep full and complete records of such investigations, supervision, assistance and rehabilitation, and of all certifications of persons for employment or benefits and cancellations thereof, in such manner and form as required by the Commissioner.
(f) 
Bring about appropriate action for commitment to any state or county institution when the best interests of the needy persons would be so served.
(g) 
Enforce the appropriate provisions of N.J.S.A. 44:1 et seq.
A. 
Creation. Pursuant to the provisions of N.J.S.A. 26:3-9, there is hereby created within the Township of Delanco a Local Board of Health.
B. 
Members. The Board shall consist of the members of the Township Committee, the Township Assessor and a physician appointed by the Township Committee.
C. 
Terms. The public official members of the Board shall serve during their tenure in public office; the physician shall serve a term of three years or until his or her successor is appointed and qualified.
D. 
Meetings. The Board shall hold at least one meeting per year; in addition, the Board shall hold such other meetings as it shall determine appropriate in accordance with N.J.S.A. 26:3-12.
E. 
Compensation. Board members shall be paid an annual salary, the amount thereof to be fixed by the Salary Ordinance of the Township.[1]

F. 
Powers and duties. The Board of Health shall perform the duties and have the powers more particularly described in N.J.S.A. 26:3-31 et seq.
G. 
Health Officer. The Township of Delanco hereby appoints the County Health Department as its Health Officer to assist in carrying out the duties and functions of the Local Board of Health.[2]

Creation. Pursuant to the provisions of the Sewerage Authorities Law (P. L. 1946, Chapter 138)[1] of the State of New Jersey, there is hereby created a public body corporate and politic under the name and style of "The Delanco Sewerage Authority."

B. 
Legislative authority, powers and duties. The Delanco Sewerage Authority hereby created is a sewerage authority as contemplated and provided for by said Sewerage Authorities Law and shall have and exercise all of the powers and perform all of the duties provided for by said Sewerage Authorities Law and any other statutes heretofore or hereafter enacted and applicable thereto.
C. 
Compensation. Members of the Delanco Sewerage Authority may receive from the Delanco Sewerage Authority compensation for their services as members, within the limitation hereby stated that no member shall receive in excess of $1,500 per annum.

D. 
Certified copy filed with Secretary of State. A copy of this chapter, duly certified by the Township Clerk, shall forthwith be filed by said Township Clerk in the office of the Secretary of State of the State of New Jersey.
A.

Pursuant to the provisions of Chapter 64 of Title 40 of the Revised Statutes of New Jersey,[1] there is hereby created in the Township of Delanco a Commission which shall be known as "The Shade Tree Commission of the Township of Delanco." Said Commission shall consist of seven members and two alternates to be appointed by the Mayor pursuant to N.J.S.A. 40:64-1 et seq., which members shall be residents of the Township and shall serve without compensation.

Powers and duties. The Commission hereby created shall be a Shade Tree Commission as contemplated and provided for by said statute and shall have and exercise all of the powers and perform all the duties provided for by said statute.
C. 
Regulation, planting, care and control of trees, shrubbery. The regulation, planting, care and control of shade and ornamental trees and shrubbery upon and in the streets, highways, public places, parks and parkways of the Township, except county highways, parks and parkways unless the County Shade Tree Commission shall assent thereto, shall be exercised by and be under the authority of the Commission hereby created.
