It is hereby found and declared that the existing Beverly City Sewer Plant servicing the Township of Delanco is incapable of effectively treating food waste, and that the costs of upgrading the Beverly City Sewer Plant to treat food waste cannot be spread across those users with garbage disposal systems and should not be spread across all users. In accordance with the request of the Delanco Township Sewerage Authority, created pursuant to §
10-22, the Township hereby finds it necessary to ban garbage disposal systems within the Township of Delanco.
As used in this chapter, the following terms shall have the meanings
indicated:
GARBAGE DISPOSAL SYSTEM
A mechanical system, whether used for residential or commercial purposes,
designed to break down food waste generated in the preparation and consumption
of meals consisting of food scraps, soiled paper and other materials.
It shall be unlawful for any person to install, insert, attach or use
a garbage disposal system within the Township of Delanco where such waste
created from the garbage disposal system is discharged, directly or indirectly,
into the Delanco Township sewer system.
Any person who violates the provisions of this chapter shall be subject to the penalty set forth in §
1-14, the general penalty provisions of the Delanco Township Code. Each day shall be considered a separate day of violation, and penalties under this chapter shall accrue in the discretion of the Municipal Court Judge.
It shall be the duty and responsibility of the Delanco Township Sewerage
Authority and the Delanco Township Plumbing Inspector to enforce the provisions
of this chapter.
