§ 110-1 Statement of findings.

The Board of Commissioners of the City of Margate City finds and determines that it is in the best interest of the City of Margate City to establish a Construction Code Enforcing Agency and a Construction Board of Appeals within the City of Margate City.

§ 110-2 Agency established; subcode officials designated.

There is hereby established in the City of Margate City a State Uniform Construction Code Enforcing Agency, consisting of a Construction Code Official, Building Subcode Official, Plumbing Subcode Official, Electrical Subcode Official and such other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code.

§ 110-3 Fees.

The Uniform Construction Code fees shall be as follows:

A. 

Plan review fee. Twenty percent of the total permit fee shall be deemed to be the plan review fee.

B. 

Construction permit fees for the building subcode shall be as follows:

(1) 

The minimum fee for the building subcode shall be $58.

(2) 

For new construction, the fees shall be based on the following:

(a) 

Residential R-3 and R-5 Use Groups: $0.022 per cubic foot of volume.

All other use groups: $0.027 per cubic foot of volume.

(3) 

For additions, the fees shall be based on the following:

(a) 

Residential R-3 and R-5 Use Groups: $0.022 per cubic foot of volume.

All other use groups: $0.027 per cubic foot of volume.

(4) 

For combinations of additions or renovations, the fee shall be computed separately.

(5) 

For renovations and alterations, the fee shall be $30 per $1,000 of the estimated cost of work for the first $50,000 and $23 per $1,000 of the estimated cost of work for the next $50,000 and $19 per $1,000 of the estimated cost of work thereafter.

(6) 

For a demolition permit, the fees shall be as follows:

(a) 

Use Group R-3 and R-5: $100.

All other use groups: $125.

(7) 

For the construction of a fence, there will be a flat fee of $58.

(8) 

For the construction of a sign, the fee shall be $2.50 per square foot, with a minimum fee of $58.

For the construction of a pool, there will be flat fee of $189.

(10) 

For asbestos abatement, the fee shall be $70.

(11) 

For asphalt paving, the fee shall be $25 per $1,000 of the estimated cost of the work, with a minimum fee of $58.

(12) 

For curbing, sidewalk and concrete work, the fee shall be $25 per $1,000 of the estimated cost of the work, with a minimum fee of $58.

(13) 

For the installation or construction of a temporary structure, there shall be a flat fee of $150, plus the cost of all necessary electrical, plumbing and service connections.

(14) 

For the installation of piles and bulkheads that support a building or structure or if the bulkhead is used as a retaining wall that is part of the means of egress, the fee shall be $25 per $1,000 of estimated cost of the work, with a minimum fee of $58. For the installation of piles and bulkheads, the fee shall be $25 per $1,000 of the estimated cost of the work, with a minimum fee of $58.

(15) 

The fee for changing from one use group to another use group shall be a flat fee of $150.

(16) 

For the moving of a building or a structure from one lot to another, the fee shall be $25 per $1,000 of the estimated cost of the footing and foundation installation, plus the cost of all necessary electrical, plumbing and service connections, with a minimum fee of $58.

(17) 

The fees for certificates shall be:

(a) 

Certificate of occupancy:

Continuing certificates of occupancy: $151.

C. 

For the elevator subcode, the fees are set by the State of New Jersey in N.J.A.C. 5:23-12.6, Test and Inspection Fees. If the City of Margate uses a third-party agency to perform inspections, the fee will be in accordance with the contract with the third-party agency, which is currently 49%. The City of Margate shall charge an administrative fee of 35% as provided for in N.J.A.C. 5:23-4.18(k)VI for all inspections conducted by private on-site inspection agencies.

D. 

Construction permit fees for the electrical subcode shall be as follows:

(a)

G. 

The fee for an application for a variation, in accordance with N.J.A.C. 5:23-2.10, shall be:

(1) 

For Class I structures: $748.

For Class III structures: $300.

H. 

The fee for reinstatement of lapsed permits shall be 50% of the total sum of the construction permits issued, provided that the minimum fee shall be $58.

I. 

In order to provide training, certification and technical support programs required by the Uniform Construction Code Act and regulations, the enforcing agency shall collect, in addition to the fees specified above, a surcharge fee of $0.0034 per cubic foot of volume for new construction and additions and $1.70 per $1,000 of the cost of alterations and renovations. These fees shall be remitted quarterly to the Department of Community Affairs, State of New Jersey.

J. 

For the purpose of determining costs, the Construction Official may require copies of bona fide contracts.

§ 110-3.1 Waiver of fees for work promoting accessibility by disabled persons.

[Added 12-23-1998 by Ord. No. 1998-30]

In accordance with N.J.S.A. 52:27D-126e no person shall be charged a construction permit surcharge fee or enforcing agency fee for any construction, reconstruction, alteration or improvement designed and undertaken solely to promote accessibility by disabled persons to an existing public or private structure or any of the facilities therein. Additionally, a disabled person, or a parent or sibling of a disabled person, shall not be required to pay any municipal fee or charge in order to secure a construction permit for any construction, reconstruction, alteration or improvement which promotes accessibility to his own living unit.

§ 110-4 Fee schedule.

The Construction Code Official shall prepare and submit to Margate City, biannually, a report recommending a fee schedule based on the operating expenses of the Agency and any other expenses of the municipality fairly attributable to the enforcement of the State Uniform Construction Code Act.

§ 110-5 Rules and regulations.

This chapter and the Construction Code Enforcing Agency and regional Construction Board of Appeals created hereunder shall be subject to such rules and regulations as may, from time to time, be lawfully promulgated by appropriate agencies of the State of New Jersey.

§ 110-6 Waiver of certain fees for charitable organizations.

[Added 2-28-2002 by Ord. No. 2002-04]

Municipal subcode permit fees (excluding elevators) shall be waived for all charitable organizations recognized under I.R.C. § 501(c)(3). The preceding shall apply to all permits payable on or after January 1, 2002.
